The commune-level People's Committee decides to establish, reorganize, and dissolve public non-business units under the commune-level People's Committee.

The Ministry of Home Affairs has just issued an official dispatch guiding public non-business units (DVSNCL) providing basic and essential multi-sectoral and multi-field public non-business services at the commune level.

The guiding official dispatch is based on the implementation of the Party's guidelines and orientations, the Central Steering Committee on summarizing the implementation of Resolution No. 18-NQ/TW and Resolution No. 105/NQ-CP of the Government related to arranging and reorganizing public service units in localities.

According to the Ministry of Home Affairs, Decree No. 283/2025/ND-CP amending and supplementing a number of articles of Decree No. 120/2020/ND-CP of the Government regulating the establishment, reorganization, and dissolution of PPPs has stipulated conditions for the establishment, reorganization, and dissolution of PPPs, including PPPs providing basic and essential multi-sectoral and multi-field public service services at the commune level.

At the same time, stipulating the responsibilities of the Minister in charge of industry management in promulgating specific criteria for classifying, conditions for establishing, merging, consolidating, and dissolving VNUs by industry and field according to their authority.

On that basis, the Government decentralizes authority to the Commune-level People's Committees to decide on the establishment, reorganization, and dissolution of Private Enterprises under the Commune-level People's Committees.

This ensures compliance with the principles of decentralization of authority, decentralization, and delegation of state management powers according to the provisions of the Law on Organization of the Government and the Law on Organization of Local Governments.

Regarding the functions, tasks, powers and organizational structure of multi-sectoral and multi-field CBs at the commune level, the Ministry of Home Affairs said that Decree No. 150/2025/ND-CP of the Government stipulating the organization of specialized agencies under the People's Committees of provinces and cities directly under the Central Government and People's Committees of communes, wards, and special zones under provinces and cities directly under the Central Government (amended and supplemented in Decree No. 370/2025/ND-CP) has stipulated the responsibilities of Ministers and Heads of ministerial-level agencies to guide the functions, tasks, powers and organizational structure of CBs under industries and fields in localities according to the provisions of specialized laws.

At the same time, Decree No. 283/2025/ND-CP stipulates the responsibilities of provincial-level People's Committees in directing the functions, tasks, and powers of public service units providing basic and essential public service services in many industries and fields at the commune level, ensuring compliance with the guidance of the ministry managing industries and fields and in accordance with the requirements arising in the commune level.

Based on the guidance of sectoral and field management ministries and the direction of provincial-level People's Committees and commune-level People's Committees, regulations on functions, tasks, powers, and organizational structure of public service units providing basic and essential multi-sectoral and multi-field public service services under commune-level People's Committees.

In case of difficulties and obstacles in the implementation process, it is requested that localities give opinions to the Ministries managing industries and fields for guidance according to their authority.
