Conditions for soldiers enlisted after 1975 to enjoy the regime

The Ministry of National Defense responds to the proposal on policies and regimes for veterans who joined the army after 1975 to receive health insurance and funeral expenses.

On March 6, according to the Ministry of National Defense's Electronic Information Portal, the Ministry of National Defense received a petition from voters of Lam Dong province sent by the Government Office under Official Dispatch No. 687/VPCP-QHDP dated February 24, 2025.

Accordingly, voters of Lam Dong province recommended that people who are members of the Veterans Association who enlisted after 1975 in areas not connected to islands or borders should not enjoy the regime according to Decision No. 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister on the regime and policies for those who participated in war, defended the Fatherland, and performed international duties in Cambodia, helping Laos after April 30, 1975 who were demobilized, discharged, or quit their jobs, such as health insurance and funeral allowances.

Voters in Lam Dong province recommended that the Government direct ministries and branches to study, review, and consider policies to resolve these veterans.

Responding to the proposal, the Ministry of National Defense said that according to the provisions of Decision No. 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister on regimes and policies for subjects participating in the war of national defense, performing international missions in Cambodia, helping Lao friends who have been demobilized, discharged from the army, or quit their jobs after April 30, 1975, one of the conditions to enjoy the regimes and policies according to the above Decision is that soldiers must have time to directly participate in combat, directly serve in combat at the southwestern border, the northern border, carry out pulro search missions in the Central Highlands during and in the prescribed time and area or perform international missions in Laos and Cambodia.

Not all soldiers who joined the army after April 30, 1975 are entitled to the regime according to Decision No. 62/2011/QD-TTg of the Prime Minister.

The regulation of the subjects and conditions for enjoying the above regimes and policies has been carefully studied and considered by ministries and branches, and reported to the Government Party Committee to submit to the Politburo for approval, the Prime Minister to issue a decision on implementation; ensuring compliance with the characteristics and nature of the war to protect the Fatherland and the socio-economic conditions of the country.

Currently, the subjects and conditions for veterans in the group participating in health insurance paid by the State budget are stipulated in Clause 4, Clause 5, Article 3 of Decree No. 146/2018/ND-CP dated October 17, 2018 of the Government, detailing and guiding the implementation of a number of articles of the Law on Health Insurance.

Therefore, the proposal to add members to the Veterans Association who are not eligible for the regime under Decision No. 62/2011/QD-TTg dated November 9, 2011 of the Prime Minister to enjoy health insurance, funeral allowance... as voters have proposed is not under the management and scope of the Ministry of National Defense's proposal.

Therefore, the Ministry of National Defense requested the National Assembly Delegation of Lam Dong province to forward the above petition of voters to the Ministry of Health for study and response according to its authority.
