On June 27, the National Assembly passed the Law amending and supplementing a number of articles of the Law on the Vietnam Fatherland Front (VFF), the Law on Trade Unions, the Law on Youth and the Law on Grassroots Democracy with 92.05% of National Assembly deputies present in favor.
This Law takes effect from July 1, 2025.
Before passing the law, Politburo member, Secretary of the Party Central Committee, Chairman of the Central Committee of the Vietnam Fatherland Front Do Van Chien presented a report on the reception, revision and completion of the draft law.
Mr. Do Van Chien said that the draft law has closely followed and fully and accurately concretized the provisions in Articles 9, 10, Clause 1, Article 84 and Article 110 of the 2013 Constitution (amended and supplemented in Resolution No. 203/2025/QH15), especially clearly demonstrating the "honorable" relationship, the principles of democratic commercialism, coordination and unity of actions chaired by the Vietnam Fatherland Front.
Regarding the Law on the Vietnam Fatherland Front, the draft law has fully and accurately specified the provisions in Clause 1, Article 9 of the 2013 Constitution (amended and supplemented) on the position, functions, rights and responsibilities of the Vietnam Fatherland Front.
Clause 2, Article 5 of the draft law is revised in the direction of removing the phrase "member organizations" to ensure compliance with Clause 2, Article 9 of the 2013 Constitution (amended and supplemented).
After the revisation, Clause 2, Article 5 stipulates that Socio-political organizations (including the Vietnam Trade Union, the Vietnam Farmers Association, the Ho Chi Minh Communist Youth Union, the Vietnam Womens Union, the Vietnam Veterans Association) and mass organizations assigned by the Party and State under the Vietnam Fatherland Front are organized and operate uniformly in the Vietnam Fatherland Front.
Article 1 of the Trade Union Law has been revised to ensure compliance with Article 10 of the 2013 Constitution, thereby removing the phrase from cadres, civil servants, and public employees, only listing the trade union as representative, caring for, and protecting the legitimate and legal rights and interests of union members and workers.
Add the phrase "one-stop-shop" and make a provision "to be the only representative of workers at the national level in labor relations and international relations with trade unions".
Implementing the policy of ending the activities of civil servant trade unions and armed forces trade unions according to Resolution No. 60-NQ/TW dated April 12, 2025 of the Party Central Committee and according to Conclusion No. 157-KL/TW, the draft law stipulates that public service units that do not receive 100% of their salaries from the state budget are subject to paying trade union fees (due to these units still having trade union organizations).
The draft law adds Clause 7 to Article 31 of the Trade Union Law, stipulating that Every year, the Vietnam General Confederation of Labor reports to the Standing Committee of the Central Committee of the Vietnam Fatherland Front on the estimate and settlement of trade union finances of the Vietnam Trade Union as prescribed in Points a, b, d, Clause 1, Article 29 and Clause 2, Article 31 of this Law.
The regulation aims to ensure compliance with the arrangement and streamlining of the apparatus of the Vietnam Fatherland Front agencies when the trade union is "under the" Vietnam Fatherland Front, ensuring consistency between the level 1 and level 2 budget units.
This is in line with the responsibility of the Standing Committee of the Vietnam Fatherland Front Committee in comprehensively leading and directing the management of assets and finances of the Central Committee of the Vietnam Fatherland Front in Decision No. 304-QD/TW.
At the same time, the draft law supplements the regulation on assigning the Government to specify the regulation on public service units not receiving 100% of salaries from the state budget to ensure consistency and synchronization with the Government's regulations on public service units with degrees of financial autonomy, ensuring publicity and transparency on the subjects of trade union fee payment and facilitating the application process.
