The Ministry of National Defence has just responded to voters' petitions regarding a number of contents on the proposal to amend and supplement a number of articles of the Law on Officers of the Vietnam People's Army (VPA) (Law on Officers).
The Ministry of National Defence said that, implementing the Prime Minister's conclusion on the Ministry of National Defence conducting a preliminary and final review of the Law on Officers and related documents to promptly propose amendments and supplements according to regulations (Document No. 17/TB-VPCP dated March 18, 2022 of the Office of the Government); the Ministry of National Defence has directed the organization to summarize the implementation of the Law on Officers from the regimental level and equivalent and above to the Ministry of National Defence level.
Based on the results of the summary of the implementation of the Law on Officers, the Ministry of National Defence has prepared a draft Law amending and supplementing a number of articles of the Law on Officers, proposing that the Government submit it to the National Assembly for consideration and approval at the 8th Session (October 2024).
In particular, the draft Law has amended and supplemented the basic positions of officers, increased the age limit for active service of officers from 1 to 5 years so that officers (Major, Lieutenant Colonel) upon retirement will basically receive the maximum salary according to the provisions of the Law on Social Insurance; overcome difficulties and inadequacies in practice regarding regimes and policies (such as housing policies) for officers, ensuring feasibility, conformity with the legal system and the nature and tasks of the Army "as a special labor sector".
Previously, voters in Thai Binh and Ha Tinh provinces also petitioned the Ministry of National Defence to study and submit to the National Assembly for consideration of amending and supplementing the Law on Officers to resolve outstanding issues and shortcomings, such as: Officer positions; age of officers in active service; ceiling for general ranks; shortening the time limit for promotion; regimes and policies for officers to ensure consistency with the Labor Code and the Law on Social Insurance (amended)".
It is expected that at the 8th Session of the 15th National Assembly (October 2024), the National Assembly will comment and consider approving the draft Law amending and supplementing a number of articles of the Law on Officers according to simplified procedures.
The National Assembly's Defense and Security Committee (QPAN) has just held its 12th plenary session to review this draft Law.
Examining the draft law, the QPAN Committee basically agreed to amend it to increase the maximum service age of officers of the Vietnam People's Army.
In which: Lieutenant: 50 years old; Major: 52; Lieutenant Colonel: 54; Lieutenant Colonel: 56; Colonel: 58; General: 60.
According to the QPAN Committee, this is to ensure compliance with the Party's policy on adjusting the retirement age and is consistent with the provisions of the 2019 Labor Code on retirement age, ensuring that military officers participating in social insurance are eligible to receive up to 75% of their salary according to the provisions of the Law on Social Insurance (amended).
