On June 18, the Ministry of Justice announced that it had just held a meeting of the Council for appraisal of the draft Decree of the Government amending and supplementing a number of articles of Decree No. 118/2021/ND-CP detailing a number of articles and measures to implement the Law on Education and Training (amended in Decree No. 68/2025/ND-CP dated March 18, 2025) and Decree No. 120/2021/ND-CP of the Government regulating the regime for applying educational measures in communes, wards and towns.
The meeting was chaired by Mr. Nguyen Quoc Hoan - Director of the Department of Legal Document Development (Ministry of Justice), with the participation of members of the Appraisal Council representing agencies: Ministry of Industry and Trade, Ministry of Home Affairs, Ministry of Foreign Affairs, Ministry of Finance, Ministry of Public Security, Ministry of National Defense, Department of International Law, Department of Judicial Administration... and Mr. Ho Quang Huy, Director of the Department of Document Inspection and Handling of Administrative Violations (KTVB&QLXLVPHC) and Ms. Nguyen Thanh Ha, Deputy Director of the Department of KTVB&QLXLVPHC - representative of the drafting agency.
At the meeting, Mr. Nguyen Hoang Viet, Head of the HCMC Export Processing Management Department, Department of Transport and HCMC Export Processing and the main contents of the draft Decree were briefly presented.
Accordingly, the draft Decree is expected to supplement regulations on: Submitting decisions on administrative sanctions for enforcement; transferring case files with signs of crime to the criminal proxy agency; implementing administrative sanctions in the electronic environment.
At the same time, the draft Decree also plans to amend and adjust regulations related to making records, sanctioning authority, forms and a number of other contents to suit the reorganization of the administrative apparatus according to the two-level local government model.
The members of the Appraisal Council focused on discussing and evaluating aspects such as: The necessity of issuing the Decree; compliance with the Constitution, the Law on administrative procedure, legal documents passed by the National Assembly at the 9th Session of the 15th National Assembly and the ability to implement in practice, especially for new content such as administrative procedure in the electronic environment.
Some opinions suggested clarifying the conditions and procedures for applying administrative procedures in the electronic environment, updating the concepts to ensure compliance with the Law on Electronic Transactions, the Law on Identification and related documents. At the same time, the amendment of regulations on making administrative violation records also received special attention from delegates.
Concluding the meeting, Mr. Nguyen Quoc Hoan - Director of the Department of Legal Document Development - highly appreciated the proactiveness and seriousness of the Department of Transport and Investment of Ho Chi Minh City in drafting the Decree.
He suggested that the drafting agency continue to study and fully absorb the opinions of the Appraisal Council, complete the draft to ensure the quality of the content and legislative techniques and submit to the Government for promulgation in a timely manner at the same time as the Law amends and supplements a number of articles of the Law on Bankruptcy.
