According to the Ministry of Culture, Sports and Tourism (MOCST), some regulations in Decree 105/2012/ND-CP on organizing funerals for cadres, civil servants and public employees have not yet kept up with the current situation, there are still opinions reflecting and lacking consensus on feasibility and reasonableness.
The Ministry of Culture, Sports and Tourism is drafting a decree to amend and supplement a number of articles of Decree 105/2012. The draft decree proposes to add a number of contents such as the deciding authority of the Politburo related to "organizing a national mourning for high-ranking cadres who have made great contributions and contributions to the revolutionary cause of the Party, State and people, and have great prestige domestically and internationally".
Accordingly, there are 4 forms of funeral organization including: National Funeral; State-level funeral; high-level funeral; funeral for cadres, civil servants, and public employees.
Cadres who are holding or ceasing to hold one of the positions of General Secretary, President, Prime Minister, or Chairman of the National Assembly when they retire will be held a national funeral.
The draft adds a provision for cases where a person who has passed away from a position holding one of the above 4 positions has been dismissed from office, retired from work, retired early, or retired due to violations or shortcomings; funerals are held in a high-level manner, instead of a national funeral.
In addition, the drafting agency proposed to add Clause 3, Article 5 on the organization of high-level funerals for the deceased who are cadres under the management of the Politburo and the Secretariat, and are allowed by competent authorities to resign, retire early, retire early, or retire according to regulations due to violations or shortcomings.
Clause 3 stipulates: "In cases where a person who has passed away from death to hold one of the positions specified in Clause 1 of this Article (Article 5) is allowed by competent authorities to resign from office, retire early, retire early according to regulations due to violations or shortcomings, the funeral will be held in the form of a high-level funeral".
Amend and supplement a number of points, Clause 21 such as: In cases where a person who has passed away from office to hold one of the positions specified in Clause 1 of this Article is allowed by competent authorities to resign from office, retire early, retire according to regulations due to violations or shortcomings, the funeral will be held in the form of a high-level funeral; disciplined by dismissal, the funeral will be held in the form of a funeral for cadres, civil servants, and public employees.
The draft amends and supplements a number of Clauses of Article 34, such as cadres and civil servants holding positions or ceasing to hold positions under the management of the Politburo and the Central Party Secretariat (except for positions held at the National Funeral Service and State-level Funeral Service); cadres who participated in revolutionary activities before January 1, 1945 (civil revolutionary) were awarded the First Class Medal or higher; cadres serving in the South during the anti-US period (1954 - 1975) were awarded the First Class Medal or higher; outstanding social, cultural and scientific activists (honored with the Ho Minh - individual award) or the Ho Chi Minh - individual award or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Ho Chi Minh Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal or the Medal of the President.

The draft decree also adds a number of other contents such as encouraging the use of glass doormates on coffin covers, moving towards using coffins without glass doors; limiting spraying and spreading votive paper; encouraging organizations and individuals to use rotating flower wreaths in visitation ceremonies...
The Ministry of Culture, Sports and Tourism proposes to keep the method of hanging national flags to invite funerals as current regulations, instead of adjusting it according to the practice in some countries around the world.
The Ministry of Culture, Sports and Tourism quoted the Ministry of Foreign Affairs' opinion affirming that there is no international document regulating the hanging of flags for countries (including the United Nations), so using the basis as international practice to amend the regulation on hanging flags in the National Funeral Home is not enough basis.
According to current regulations, the National Day Funeral Ceremony lasts 2 days. During this time, agencies, offices nationwide and representative agencies of Vietnam abroad will hang invitation flags, have ribbon covers, and not organize public entertainment and recreation activities.
