The Ministry of Home Affairs is seeking opinions on the draft Decree regulating disciplinary action against civil servants. The above draft decree will replace the regulations in Decree 112/2020, Decree 71/2023.
Notably, the draft decree reserves Article 16 for regulations on the composition of the Civil Servant Disciplinary Council.
For non-management officials, the Disciplinary Council has 3 members, including:
The Chairman of the Council is the head or deputy of the head of the agency authorized to handle disciplinary action;
1 Member of the Council is a representative of leaders of agencies, organizations, and units directly using public employees;
1 Council member is the representative of the advisory department on personnel organization work of the competent disciplinary action agency. The competent disciplinary action agency appoints a representative of the unit advising on personnel organization work or a representative of the agency, organization, unit using public employees to participate in recording the minutes of the Council meeting.
For management officials, the Disciplinary Council has 3 members, including:
The Chairman of the Council is the head or deputy of the head of the agency authorized to handle disciplinary action or the representative of the agency's leadership authorized to handle disciplinary action;
1 Member of the Council is a representative of leaders of agencies, organizations, and units directly using public employees;
1 Member of the Council is a representative of the advisory department on personnel organization work of the agency with the authority to handle disciplinary action.
The competent authority for disciplinary action shall appoint a representative of the unit advising on personnel organization work or a representative of the agency, organization, or unit using public employees to participate in recording the minutes of the Council meeting.
