The Ministry of Home Affairs said that the contents related to Village Heads and Heads of Residential Groups are stipulated in the Law on Grassroots Democracy and Decree No. 59/2023/ND-CP dated August 14, 2023 of the Government detailing a number of articles of the Law on Grassroots Democracy.
According to Decree No. 59/2023/ND-CP, for the meeting of the community to elect a Village Head, a Head of a Residential Group; a member of the Community Investment Supervision Board, a member of the People's Inspectorate in communes, wards and towns, the representative of the Front Working Committee in the village or residential group shall introduce the list of candidates by the Front Working Committee in the village or residential group that has agreed with the village Party Cell Committee, residential group and requested the representative of the household to attend the self-national meeting or nominate a person with sufficient conditions to participate in the election.
At the end of the discussion, the meeting chairman will synthesize the opinions discussed, propose the contents that need to be voted on and the voting options in the form of a raised hand or secret ballot for the participants to vote for. The option was chosen when more than 50% of household representatives attended the meeting and raised their hands to vote in agreement.
For the form of increased voting, the voting results are counted immediately at the time of voting and recorded in the meeting minutes.
For the form of secret ballot, the meeting chairman proposes the number and list of Counting Committees from 3 to 5 people (including Heads and members) for household representatives to attend the meeting to vote by raising their hands. The vote counting committee is decided when more than 50% of household representatives attended the meeting and raised their hands to vote in agreement.
The ballot counting committee guides the rules, how to record ballots, vote and how to distribute ballots.
After the voting is over, the Ballot Counting Committee conducts the ballot counting (During the ballot counting process, the Ballot Counting Committee invites 2 large households to attend a meeting to witness the ballot counting) and makes a record of the ballot counting according to form No. 2 attached to this Decree.
The Head of the ballot counting committee announced the ballot counting results at the meeting. The record of the vote counting was made in 3 copies and attached to the Decision of the community to the People's Committee at the commune level, the Vietnam Fatherland Front Committee at the commune level and kept in villages and residential groups.
The meeting chairman will announce the voting results for each voting content and the meeting conclusion. The decision of the community is expressed in the form of documents: resolutions, meeting minutes, memorandums of understanding, and agreements of the community, clearly expressing the content of the community decision as prescribed in Clause 2, Article 20 of the Law on Grassroots Democracy.
In case the meeting elects the Village Head or Residential Group Head, the elected person will chair the meeting. If the winner cannot be identified, the reason for not being able to elect a Village Head or Residential Group Head should be stated in the meeting minutes to report to the People's Committee at the commune level for consideration and decision on the organization of re-election.
