The Ministry of Justice is reviewing the draft Decree regulating the framework for the number of Vice Chairmen of the People's Committee, the number and structure of People's Committee members; the order and procedures for approving the results of the People's Council in electing, dismissing, and removing Chairmen and Vice Chairmen of the People's Committee; the order and procedures for transferring, removing Chairmen and Vice Chairmen of the People's Committee and assigning the authority to Chairmen of People's Committees at all levels. The Ministry of Home Affairs is the agency in charge of drafting the Decree.
According to the draft submission, based on the orientation in Conclusion No. 187-KL/TW of the Politburo and the Secretariat on the orientation of the number of deputy heads in the political system, the draft decree determines the maximum number of Vice Chairmen of the People's Committee on the basis of classifying administrative units before consolidation and merger and based on the scale and characteristics of consolidation (merging from 2 units or 3 units) to suit the practical situation.
For provincial and centrally-run cities implementing consolidation and merger, the draft stipulates that Ho Chi Minh City has no more than 8 Vice Chairmen.
At the same time, centrally-governed cities are formed through the merger and consolidation of 3 units with no more than 7 Vice Chairmen; 2 units are merged with no more than 6 Vice Chairmen.
The province is formed by merging 2 provinces, including at least 1 type I province or merging 3 provinces with no more than 6 Vice Chairmen. Provinces formed from 2 provinces of type II and III have no more than 5 deputy levels.
For provinces and cities that do not implement consolidation and merger according to the classification of administrative units before the draft decree takes effect, type I provinces will have no more than 4 vice chairmen. In addition, type II and III provinces have no more than 3 vice chairmen.
For centrally-governed cities, Hanoi is expected to have no more than 5 Vice Chairmen of the People's Committee and Hue City has no more than 4 Vice Chairmen of the People's Committee.
At the same time, to ensure flexibility and meet the requirements of cadre work, the draft decree stipulates that in cases where the Politburo and the Secretariat mobilize and rotate cadres to hold the position of Vice Chairman of the Provincial People's Committee, this number is outside the prescribed framework.
Localities with separate resolutions of the National Assembly regulating other areas will comply with the provisions of that resolution.
