Mr. Tran Minh Thanh (Soc Trang) learned about the Regulations on organization and operation of mass associations assigned by the Party and State at the Central level, issued together with Decision 118-QD/TW dated August 22, 2023 of the Secretariat. Provincial/municipal Party Committees have specified this regulation in localities.
According to Regulation 118 (and regulations of the provincial/municipal Party Committee), Clause 2, Article 7 stipulates that people assigned or transferred to work at the association according to the decision of the competent authority shall receive allowances according to regulations for cadres and civil servants. With the above regulation, some provinces have implemented it.
However, some provinces have not implemented it because they believe that according to the provisions of Circular 03/2014/TT-BNV, only those who are transferred are entitled to public service allowances.
The failure to institutionalize this regulation according to the Party's policy in Regulation 118 has affected the legitimate and legal rights of cadres and civil servants assigned to work at the association.
"We respectfully request that the Ministry of Home Affairs pay attention to promptly amending Circular 03/2014/TT-BNV in accordance with the Party's policy in Regulation 118 to ensure the rights of civil servants to receive public service allowances," said Mr. Tran Minh Thanh.
Regarding the reflection and recommendation of Mr. Tran Minh Thanh, the Ministry of Home Affairs has responded on the Ministry's Electronic Information Portal.
Accordingly, institutionalizing the Party's policies, the Ministry of Home Affairs has coordinated with relevant agencies to develop a draft Decree to replace Decree No. 45/2010/ND-CP dated April 21, 2010 of the Government regulating the organization, operation and management of associations (including proposals to regulate the regime and policies for those working at associations assigned by the Party and State) to submit to the Government and the Prime Minister for consideration and promulgation.
Currently, the Ministry of Home Affairs has compiled, received, and explained the opinions of Government members; reported to the Government and the Prime Minister. Implementing the direction of the Government leaders, the Ministry of Home Affairs continues to coordinate with the ministries of Justice, Planning and Investment, and Finance to submit to the Government and the Prime Minister in September 2024.
When the draft Decree was issued by the Government, the Ministry of Home Affairs announced that Circular No. 03/2014/TT-BNV dated June 19, 2014 had expired according to the provisions of the Law on Promulgation of Legal Documents.
