On the afternoon of May 22, Party Central Committee member, Deputy Prime Minister Tran Hong Ha chaired a direct and online meeting with a number of ministries, branches and localities on the Decree on decentralization, delegation and division of authority in the field of construction and transportation.
Concluding the meeting, the Deputy Prime Minister asked the Ministry of Construction to continue to complete the draft decrees, clearly identify the scope of decentralization and decentralization from the authorities of the Government, the Prime Minister and the minister of the local degradation, or from the Government, the Prime Minister to the Minister, avoid overlapping or to leave the space.
In particular, the Ministry of Construction must review and inherit the relevant contents on the determination of authority, decentralization and delegation of authority that have been adjusted in relevant laws or laws that are being amended and supplemented and will take effect from July 1, 2025; not include the tasks that have been decentralized and delegated in previous decrees and circulars.
The Deputy Prime Minister requested that the difference between decentralization and delegation of power must be clarified. Decentralization means that subordinates are responsible for themselves; decentralization means that superiors are still responsible, so there must be conditions to ensure.
According to Deputy Prime Minister Tran Hong Ha, there should be a general guideline, general and separate criteria for decentralization and delegation of authority issued by the Ministry of Justice or the Ministry of Home Affairs.
The determination of tasks and authority retained at the central level needs to have a clear theoretical and practical basis and selection criteria. Specifically, the remaining issues related to national defense and security, key national projects, key technology or inter-provincial projects... are handed over to localities.
The Deputy Prime Minister noted that the regulation on decentralization and delegation of authority in the fields of construction and transportation also needs to be synchronized with financial and investment mechanisms and policies.
Therefore, the Deputy Prime Minister requested the Ministry of Construction to absorb the opinions of localities to continue to supplement and clarify a number of specific principles and criteria to determine the tasks retained at the provincial level.
"Department and delegation of authority must ensure continuity and inheritance and avoid stagnation, gaps or bottlenecks in the implementation of tasks in localities" - the Deputy Prime Minister said and assigned localities to carefully review and focus on contributing opinions on the contents of decentralization and delegation of authority both in terms of legal basis and implementation conditions.
