One of the important Law projects to be discussed at the 9th Extraordinary Session of the 15th National Assembly is the Law on Promulgation of Legal Documents.
This Law Project is considered to be particularly important, affecting the construction and completion of the entire legal system.
Talking to the press about this issue, Deputy Minister of Justice Nguyen Thanh Tinh said that the Ministry of Justice has focused all resources on researching and developing the draft Law on Promulgation of Legal Documents (amended).
Although the National Assembly Standing Committee allowed the drafting according to the shortened procedures, to ensure the quality of the draft Law, the Government directed the Ministry of Justice to proactively implement all steps according to the provisions of the current Law.
"Currently, the draft Law is structured with 8 chapters and 72 articles (9 chapters and 101 articles less than the Law on Promulgation of Legal Documents in 2015), including very fundamental innovations, with "breakthrough" contents in the law-making process. The Law is more concise but the quality must be better. This is a requirement throughout the process of developing this draft," said Deputy Minister Nguyen Thanh Tinh.
One new issue raised in the draft law is the issue of "policy consultation".
Deputy Minister Nguyen Thanh Tinh said that the Drafting Committee has researched solutions to promote the quality of law-making work, in which "policies must be issued policies", policies must be in line with people's wishes, and if policies are correct and "on target", then the policy can be codified into laws and legal documents to have quality.
Therefore, this draft Law has provisions on policy consultation. The Drafting Committee has accepted the opinions of the National Assembly Standing Committee in the 42nd Session on February 5, 2025. Accordingly, the Drafting Committee has clarified the concept of policy consultation, which is the policy-making agency working directly with agencies and organizations, including those specifically prescribed by law, to discuss solutions to overcome difficulties and obstacles of current legal regulations, affecting development, affecting the implementation of rights and legitimate interests of people and businesses, discussing ideas for development creation, resource mobilization, and issues promoting socio-economic development as directed by General Secretary To Lam on innovation in law-making thinking.
"Policy consultation is a very common practice in many countries, but in Vietnam, it has only recently been officially regulated in the draft Law. I think this is a new, very practical regulation that demonstrates superiority and requires the efforts and determination of policy research agencies in its future implementation.
From there, policies will truly become popular solutions, consistent with development goals, creating consensus, facilitating the attraction of all resources among the people and the business community. The promulgated legal regulations will be consistent with "the Party's will and the people's will" and promote adjustments in social life" - Deputy Minister Nguyen Thanh Tinh said.
