Circular No. 29/2024/TT-BGDDT, issued on December 30, 2024 and effective from February 14, 2025, issued many regulations to tighten and make extra teaching and learning activities transparent in general education and continuing education.
On February 7, 2025, the Prime Minister also issued a telegram requesting the Chairmen of the Provincial People's Committees to strictly direct the implementation of regulations on extra teaching and learning; strictly handle violations of regulations.
In order not to be sanctioned, teachers and schools should pay attention to some regulations in tutoring.
Cases of no tutoring
Circular 29 determines that tutoring and extra curriculum is an additional teaching activity in addition to the duration specified in the educational plan for subjects in the general education program.
The Circular stipulates not organizing tutoring for elementary students, except for cases of fostering about art, physical training and sports, and life skills training. Teachers are in discipline or being investigated not to participate in tutoring.
Thus, teachers of all public, private schools or free teachers at the centers are not taught cultural subjects for grade 1 students.
Teachers can teach tutoring to foster art, sports, practice life skills for elementary students.
In particular, teachers of public schools are not allowed to open their own centers or participate in managing, operating tutoring, tutoring outside the school.
Conditions for teachers to be taught
From junior high school level or higher, the Circular does not prohibit tutoring but must carry out business registration and be tested and licensed by the functional industry. Income from tutoring activities will have to pay taxes in accordance with the law.
Another new point of the Circular is in Clause 1, Article 5, tutoring in the school must not collect students' money. The tutoring tutoring is only for students with the results of the end of the first semester of the first term of unpaste; students are selected to foster good students; Last class students voluntarily register for entrance exam review, graduation exam review according to the school's educational plan.
Organizations and individuals who want to organize tutoring with money must be registered and licensed as prescribed. The collection of tutoring must be public, transparent and comply with current regulations.
Must be publicized on the web portal or listed at the place where the tutoring facility is headquartered on subjects organized tutoring; tutoring time for each subject in each class; locations, forms, time to organize tutoring and tutoring; The list of tutoring and tutoring collection levels before enrolling tutoring and tutoring classes.
Teachers who are teaching at schools involved in extra -curricular teaching must report to the principal or director or head of the school about the subject, location, form, time to participate in tutoring.
Responsibility to manage tutoring
According to Circular 29, the responsibility to supervise teachers in contravention of regulations not only the education sector but also the participation of all levels and branches in the locality.
In particular, the People's Committees at all levels, the Department of Education and Training, the Department of Education and Training are responsible for managing, examining and monitoring tutoring and tutoring activities in the area.
At the same time, the school and the teacher must comply with the regulations on tutoring, tutoring and responsibility before the law for violations.
Schools, tutoring establishments, organizations and individuals violate regulations on tutoring, tutoring, depending on the nature and seriousness of the violation, they will be handled in accordance with the law.
In particular, according to Decree 04/2021 and Decree 127/2021 of the Government stipulating sanctioning administrative violations, by returning money to learners with teachers who violate regulations on tutoring.
In addition to refunding, many regulations required teachers to organize tutoring will be administratively sanctioned and subject to discipline.
For organizing extra teaching activities that are not eligible for a fine of 2 - 4 million VND; For organizing extra teaching activities without a license, a fine of 6 - 12 million VND must be imposed. In some more severe violations, criminal liability may be prosecuted according to regulations.
