Circular No. 29/2024/TT-BGDDT on tutoring will take effect from February 14, 2025.
The Circular stipulates not organizing tutoring for elementary students, except for cases of fostering about art, physical training and sports, and life skills training.
Other levels of education, teachers who want to teach tutoring must carry out business registration and be tested and licensed by the functional industry. Teachers of public schools are not allowed to open their own centers or participate in managing, operating tutoring, tutoring outside the school.
Violating these provisions, teachers and schools will be handled in accordance with the law.
Article 15 and 16 of Decree 112/2020 of the Government clearly define the forms of disciplining with teachers in contravention of regulations.
With teachers who do not hold the position of management in the school, they will be disciplined such as reprimanding, warning and resigning.
The teacher who taught the management position was subject to a higher discipline, depending on the degree of violations, including: reprimand, warning, dismissal and forced job.
The head of the unit will base on the level of violations to issue a decision to discipline in accordance with teachers who have tutoring in contravention of regulations. In addition, in some cases, teachers may be restricted to perform occupational activities in accordance with the relevant law.
Besides the discipline, teachers also have to be subject to administrative sanctions.
In Article 7 of Decree No. 138/2013 of the Government stipulating:
With acts of organizing the wrong tutoring activities, the subject was fined from 2 - 4 million VND;
With acts of organizing tutoring activities when not licensed, the fine must be fined 6 - 12 million.
A fine of between VND 1 million to VND 2 million for acts of organizing tutoring activities does not guarantee facilities as prescribed.
In addition, Article 3 of Decree 04/2021/ND-CP (amended and supplemented in Decree 127/2021/ND-CP) stipulates the form of sanctioning and fine levels in the field of education. In particular, if violating the regulations in education, teachers may be added such as confiscating material evidences and means of administrative violations; Suspension of operation is limited.
