Law enforcement must be a breakthrough; promote the spirit of serving the people of civil servants, ensuring the viewpoint of "people and businesses are allowed to do what the law does not prohibit".

Creating a breakthrough in law-making

In recent years, the work of law making and enforcement has achieved important results, contributing to creating a legal foundation for the rapid and sustainable development of the country. Theoretical thinking and awareness of the socialist rule of law state are constantly being perfected. The Vietnamese legal system has been formed relatively synchronously, covering most areas of social life.

The National Assemblies of each session have issued 213 laws and rules that are in effect (of which, since the beginning of the 15th term, the National Assembly has issued 65 laws; in the 7th, 8th and 9th Extraordinary Sessions alone, the National Assembly has issued 33 laws, 9 resolutions regulating the law and 52 other resolutions); The Government and the Prime Minister have issued thousands of decrees and decisions, ministries and branches have issued tens of thousands of circulars.

Along with covering most areas of social life, the quality of legal documents has also been improved.
The organization of law enforcement has had positive changes, contributing significantly to maintaining political stability, ensuring social order and safety, promoting socio-economic development and international integration.

In addition to the achieved results, Politburo member and National Assembly Chairman Tran Thanh Man pointed out that the work of law making and enforcement still has many shortcomings and limitations.
Some policies and orientations of the Party have not been institutionalized in a timely and complete manner.The thinking of law-making in some areas is still towards management, not paying due attention to promoting development, creating motivation for innovation.The quality of law-making has not kept up with practical requirements.

Decentralization and delegation of power in many fields is not strong enough, thorough enough, lacking clarity in responsibilities and authority; administrative procedures are still cumbersome and complicated, causing inconvenience to people and businesses. The organization of law enforcement is still a weak link.

In the above context, National Assembly Chairman Tran Thanh Man stated that the Politburo's issuance of Resolution No. 66-NQ/TW dated April 30, 2025 on innovation in law-making and enforcement to meet the requirements of national development in the new era is an objective requirement of the innovation process, aiming to create a breakthrough to improve the quality and efficiency of law-making and enforcement, meeting the development requirements in the new era of the country's prosperity and prosperity.

National Assembly Chairman Tran Thanh Man said that Resolution 66 clearly states 5 guiding viewpoints. That is to ensure the comprehensive and direct leadership of the Party in law-making work, strengthen the leadership of the Party in law enforcement work; identify law-making and enforcement as a "breakthrough of breakthroughs" in perfecting the country's development institutions.

The work of law-making must closely follow reality, selectively absorb the elite of humanity, make institutions and laws a competitive advantage, a solid foundation, a strong driving force for development, create space to promote "double-digit" economic growth; improve people's lives, prevent corruption, waste, and negativity to ensure national defense, security, and foreign affairs of the country.

At the same time, improve the effectiveness of law enforcement, focus on building a culture of law compliance, ensure the Suppression of the Constitution and the law, ensure close connection between law making and law enforcement; clearly identify investment in policy and law making as investment for development. The State ensures and prioritizes resources and has specific and outstanding regimes and policies for strategic research, policies, law-making and human resources directly and regularly performing these tasks.

Notably, Resolution 66 sets medium-term and long-term goals for law making and enforcement, closely following the requirements and timelines for implementing the two 100-year strategic goals set by our Party. At the same time, to ensure implementation with a roadmap, steps, focus, key points, and feasibility, the Resolution clearly defines specific goals for the coming time and for the 16th National Assembly term.

Originating from the overall interests of the country

The National Assembly Chairman said that the Resolution also identifies 7 groups of tasks and solutions that need to be focused on implementing in the coming time.

First of all, the Resolution affirms that law making and enforcement is a key task of building a socialist rule-of-law state, which needs to be carried out under the comprehensive and direct leadership of the Party.

An important highlight is the fundamental innovation of the thinking of law-making. The law must fully and promptly institutionalize the Party's policies; come from the interests of the whole country, prioritizing the protection of human rights and civil rights. The law is identified as a competitive advantage of the country, therefore the Resolution requires a drastic abandonment of the thinking of "if you can't manage it, then ban it" - instead, it must encourage creativity and unlock development resources.

Legal regulations need to be stable, simple, easy to understand, with people and businesses as the center. Law-making work is required to be very proactive in strategic research and selective consultation with international experience, in order to increase predictability and improve policy quality.

At the same time, the Resolution emphasizes the need to perfect a transparent and professional legislative process and publicize comments, not pushing difficulties for people and businesses; requiring breakthroughs in law enforcement; promoting the spirit of serving the people of civil servants, ensuring the viewpoint of "people and businesses are allowed to do what the law does not prohibit".

The Fatherland Front, unions and social organizations are actively mobilized to participate in supervising law enforcement and disseminating legal education. The Resolution requires building a culture of law compliance and diversifying policy communication (including the application of digital technology). At the same time, resolutely do not "criminalise" economic and civil relations, do not tolerate administrative measures to resolve economic disputes, maintain fairness and flexibility of the law.
