The Government has issued Decree No. 18/2025/ND-CP detailing a number of articles of the Electricity Law related to electricity trading activities and situations of ensuring electricity supply.
Decree No. 18/2025/ND-CP clearly stipulates the conditions for entering into electricity purchase and sale contracts for domestic purposes.
Accordingly, organizations and individuals when proposing to enter into electricity purchase and sale contracts for domestic purposes must ensure the following conditions:
The subject proposing to enter into a contract of the electricity buyer is the legal representative or authorized representative of the electricity buyer to enter into the contract.
The subject proposing to enter into a contract of the electricity seller is the legal representative or authorized person of the electricity retailer meeting the needs of the electricity buyer to enter into a contract.
The subject participating in the proposal to enter into a contract must ensure the conditions for the validity of the civil transaction according to the provisions of the Civil Code. In case a person loses civil act capacity, the legal representative of the person who loses civil act capacity is the subject participating in the proposal to enter into a contract.
In case the electricity buyer consists of many households using electricity together and signing a contract, the contracting entity of the electricity buyer is the representative of the households using electricity together who signs the contract and has a written authorization from the other households using electricity together.
The contract must clearly state the number of households using the same service (with attached list) and the electricity price applied according to the provisions of the law on electricity. The authorization is implemented according to the provisions of the law on civil affairs.
In case the electricity buyer is a tenant, the contracting party of the electricity buyer is the homeowner or the tenant authorized in writing by the homeowner.
In which, the homeowner commits to pay the electricity bill in case the tenant authorized to sign the contract fails to fulfill the obligation to pay the electricity bill.
At a location where electricity is purchased, a household is only allowed to sign one contract.
The electricity buyer prepares a dossier requesting to enter into an electricity purchase and sale contract for domestic purposes in paper form or in the form of a data message with the same value as a document as prescribed by law, and sends a set of dossiers to the electricity seller in the case of paper documents.
The dossier for requesting to enter into an electricity purchase and sale contract includes a request to enter into an electricity purchase and sale contract for domestic purposes; personal identification number of the legal representative or authorized representative of the electricity buyer as established by the National Population Database.
The electricity seller must execute the contract and supply electricity to the electricity buyer within 7 working days from the date the parties meet the provisions of the decree.
