The Ministry of Home Affairs has just completed a draft Decree on amending and supplementing Decree 178 with a broader scope of regulation and groups of subjects entitled to policies and regimes when implementing the restructuring of the apparatus of the political system.
In which the Ministry of Home Affairs proposes to amend and supplement the subjects of application, including:
Cadres, civil servants, public employees, and contractors receiving salaries from the State budget according to the provisions of the labor law before January 15, 2019 and armed forces who are at least 5 years old and have reached retirement age in agencies, organizations, and units are not directly affected by the arrangement of the apparatus but must streamline the payroll, restructure, and improve the quality of cadres, civil servants, and public employees;
People working within the staffing quota and receiving salaries from the State budget at associations assigned by the Party and the State at the central and local levels due to the direct impact of the implementation of arrangement, consolidation and merger;
Cadres who are not old enough to be re-elected or reappointed as prescribed in Decree No. 177/2024 of the Government; cadres who meet the age requirements for re-election or reappointment at the same level, with working time from the date of congress organization from 2.5 years (30 months) to 5 years (60 months) to the retirement age prescribed in Decree No. 177 and cadres participating in Party committees at Party committees in Party groups must complete their activities, with a safety period of 5 years (60 months) or less until retirement age, and there is a risk of early retirement to facilitate the arrangement of Party committee personnel in the Party Congresses at all levels towards the 14th National Congress of the Party.
Notably, in the process of reorganizing the apparatus, especially merged and consolidated agencies, the number of leaders and managers of the agencies after the reorganization is much higher than the regulations.
Therefore, to facilitate the arrangement of leadership and management to ensure the quantity in accordance with the provisions of law and create conditions for young cadres to have the opportunity to develop, the Ministry of Home Affairs proposes to add the group of "civil servants, civil servants, leaders and managers in agencies, organizations and units under the organizational structure of agencies specified in Clause 1, Article 1 of this Decree who wish to retire early to facilitate the implementation of the organizational arrangement of the political system".
Regarding amending and supplementing local additional support policies, the Ministry of Home Affairs said that currently, some localities have issued Resolutions of the Provincial People's Council on additional support policies for subjects settled according to the provisions of Decree No. 178 with too large support differences.
The Ministry of Home Affairs stated that in reality, some provinces support at 100%, some provinces support at 10%, some provinces support at an absolute amount, up to 300 million VND/person.
"To ensure correlation in policies and regimes between the central and local governments and between localities, it is recommended to stipulate that the maximum additional support policy of the locality is 30%," the Ministry of Home Affairs proposed.
