Ms. Nguyen Thi Le (Kien Giang) was born on May 1, 1975 and started working in the education sector on September 1, 1996. Currently, she is a primary school teacher with a college degree.
Due to family circumstances and her own professional capacity, Ms. Le wants to retire early under the preferential staff reduction regime.
"By November 2027, according to the earliest retirement age without taking into account other conditions, will I be able to retire early?" - Ms. Le wondered.
Regarding the reflection and recommendation of Ms. Nguyen Thi Le, the Ministry of Home Affairs said: Determining the time of streamlining the payroll and the time of retirement according to Decree No. 29/2023/ND-CP dated June 3, 2023 of the Government regulating the streamlining of payroll, decentralized to localities for implementation.
According to Article 5 of Decree 29/2023/ND-CP, the early retirement age for cadres subject to staff reduction according to the provisions of law is prescribed as follows:
- The subjects of staff reduction must be at least 5 years younger than the maximum and at least 2 years younger than the minimum and have paid 20 years of compulsory social insurance or more. Of which, there must be at least 15 years of working in a arduous, toxic, dangerous or especially arduous, toxic, dangerous occupation or at least 15 years of working in an area with particularly difficult socio-economic conditions, including working time in an area with a regional allowance coefficient of 0.7 or more before January 1, 2021.
- The subject of staff reduction must be at least 5 years younger than the maximum and at least 2 years younger than the retirement age and have paid at least 20 years of compulsory social insurance; The subject of staff reduction must be at least 2 years younger than the retirement age and have paid at least 20 years of compulsory social insurance, including at least 15 years of working in arduous, toxic, dangerous or especially arduous, toxic, dangerous occupations or jobs, or at least 15 years of working in areas with particularly difficult socio-economic conditions, including working time in areas with regional allowance coefficient of 0.7 or higher before January 1, 2021.
- The subjects of staff reduction must have a minimum age 2 years lower than the retirement age and have paid 20 years or more of compulsory social insurance (female cadres and civil servants at the commune level must have paid 15 years or more of compulsory social insurance); The subjects of staff reduction are female cadres and civil servants at the commune level who are at least 5 years lower than the maximum age and at least 2 years lower than the minimum age and have paid 15 years to less than 20 years of compulsory social insurance.
Therefore, the Ministry of Home Affairs recommends that Ms. Le consult local authorities for answers according to regulations.
