The Government has issued Decree 29/2023/ND-CP on streamlining payroll. This Decree takes effect from July 20, 2023.
According to Lao Dong, after more than 1 year since the decree took effect, there have been many comments and discussions about policies related to streamlining the payroll, including the content of early retirement.
Ms. Nong Thi Binh (Cao Bang) was born on October 20, 1969, and has participated in social insurance for 32 years. Ms. Binh wants to retire early under the staff reduction program in January 2025.
"Can I still retire 2 years early to enjoy the early retirement policy?" - Mrs. Binh wondered.
Regarding Ms. Binh's question, the Ministry of Home Affairs said: On June 3, 2023, the Government issued Decree No. 29/2023/ND-CP regulating staff streamlining.
This Decree stipulates the age requirement for subjects of staff streamlining working under normal conditions to enjoy early retirement policy, which is to be at least 5 years younger than the retirement age as prescribed in Appendix I issued with Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age.
For Ms. Nong Thi Binh, born in October 1969, the retirement date is November 2026. Thus, if Ms. Binh is subject to staff streamlining as prescribed in Article 2 of Decree No. 29/2023/ND-CP and implements staff streamlining in January 2025, she will enjoy the policy prescribed in Clause 2, Article 5 of Decree No. 29/2023/ND-CP regulating staff streamlining.
