After 10 years of implementation, the Ministry of Justice has just officially announced the Vietnamese Code. What is the significance of this Code in legal research, Deputy Minister?
- The Code was built and formed from nearly 9,000 legal documents (QPPL) still in effect at the Central level and is arranged and structured into 45 topics. Each topic has one or more headings (there are 271 headings belonging to 45 topics).
Each topic is codified from many different documents that regulate a certain field and is arranged in a scientific and logical order. The structure of the topic is based on the layout of the QPPL document with the highest legal effect among the documents codified into each topic.
With such a codification, the Code will help individuals and organizations easily and conveniently look up and search for legal regulations. Thereby, contributing to bringing the law into life and the legal level of the people is increasingly improved.
What solutions will the Ministry of Justice and other ministries and sectors implement to ensure that the Code effectively promotes its value in social life?
- After 10 years of implementation, the Code has been positively received by society. There have been nearly 2 million visits to exploit and use the Code.
In the coming time, I think it is necessary to strengthen the effectiveness and efficiency of state management in the work of systematizing legal documents and codifying the legal system.
In particular, agencies promote regular review work, promptly implement or recommend competent authorities to amend, supplement, replace, abolish or issue new documents to ensure the conformity and consistency of the legal system; accurately determine the validity of documents and promptly update legal provisions in the Code.
Ministries, branches and localities also need to continue to pay attention to directing, strengthening the organization, and improving the capacity of civil servants doing legal work in general and the work of reviewing and systematizing legal documents and codifying the legal system in particular;
Strengthen the application of information technology, especially promoting digitalization, developing artificial intelligence (AI) and ensuring financial resources to effectively implement these tasks; regularly update, manage, maintain in combination with communication, introduction and guidance for each individual, agency and organization in society to effectively exploit and use the Code.
On the side of the Ministry of Justice, what will the Ministry do to "increase" the value of the Vietnamese Code, Deputy Minister?
Through codification work, the Ministry of Justice, together with ministries and branches, has reviewed and "cleaned" more than 8,000 central legal documents, contributing to ensuring the unity and uniformity of the legal system.
In the coming time, together with relevant ministries and branches, the Ministry of Justice will continue to research and advise on perfecting the institution on reviewing and systematizing legal documents and codifying the legal system to further enhance the responsibility and effectiveness of this task, in which it is necessary to pay attention to the full management of the entire legal document system as well as the effectiveness of the documents.
The Ministry of Justice will carry out its responsibility to fully, promptly and accurately update the validity status of documents on the National Legal Database. At the same time, it will pay attention to and enhance the application of information technology, invest in and upgrade the National Legal Database, ensuring that the source of data on legal documents is "correct, sufficient, clean, and alive" and operates continuously and stably.
