Implementing Conclusion No. 34-KL/TW dated May 18, 2026 of the Politburo on arranging villages and residential groups and arranging, using, regimes and policies for non-specialized personnel at the commune level, in villages and residential groups, on May 26, 2026, the Government issued Decree No. 185/2026/ND-CP stipulating the organization and operation of villages and residential groups and regimes and policies for non-specialized personnel in villages and residential groups.
Article 4 of Decree No. 185/2026/ND-CP stipulates the organization of villages and residential groups. Accordingly, villages have village heads; residential groups have residential group heads who are non-specialized workers in villages and residential groups.
In addition to the titles of Village Head and Neighborhood Group Leader, based on task requirements, local characteristics and the balancing capacity of the local budget, the Provincial People's Council decides to arrange titles of people participating in activities in villages and residential groups to support Village Heads and Neighborhood Group Leaders or implement self-management activities of the residential community.
The election and dismissal of Village Heads and Residential Group Leaders are carried out in accordance with the provisions of the Law on Implementation of Democracy at the Grassroots Level and the Decree guiding the implementation of the Law on Implementation of Democracy at the Grassroots Level.
In cases of establishing, arranging, and reorganizing villages and residential groups, or cases of missing village heads and residential group heads, the commune-level People's Committee shall appoint temporary village heads and residential group heads to manage the activities of villages and residential groups until the village head or residential group head is elected within a period of no more than 6 months from the date of the decision appointing temporary village heads and residential group heads.
The term of office of the Village Head and Neighborhood Group Leader is 5 years.
In cases where it is necessary to ensure consistency with the time of reorganizing villages and residential groups or due to force majeure situations such as natural disasters and epidemics that cannot organize elections on time, the commune-level People's Committee decides to shorten or extend the term of office of the Village Head and Residential Group Leader but not more than 6 months.
In case it is necessary to shorten or extend for more than 6 months, the commune-level People's Committee shall report to the provincial-level People's Committee for consideration and decision.
Village heads and residential group leaders have the task of propagating and mobilizing people to implement the Party's guidelines, policies and laws of the State; village regulations and conventions of the residential community; implementing democracy at the grassroots level and movements and campaigns in the area.
Grasp the situation of community life; gather and reflect to local authorities at the commune level the legitimate petitions and aspirations of the people; promptly report issues arising in the area; participate in mediation at the grassroots level, maintain solidarity in the community;
Coordinate with the Fatherland Front Work Committee, socio-political organizations, other self-management organizations in villages and residential groups, and relevant agencies, organizations, and individuals in supporting the implementation of state management tasks of local commune-level authorities in the area.
Coordinate with the People's Inspection Board, the Community Investment Supervision Board, the Fatherland Front Work Board and relevant organizations and individuals in organizing people to participate in supervising works, projects, people's contributions and the implementation of democracy at the grassroots level in the area.
Organize propaganda and mobilize people to participate in performing national defense tasks, organize civil defense and ensure security and order in the area according to the provisions of law.
