Mr. Pham Van Quoc (character's name has been changed) is the Chairman of the Veterans Association of a ward in Bac Ninh city, Bac Ninh province.
According to the provisions of Clause 1, Article 5 of Decree No. 33/2023 dated June 10, 2023, the Chairman of the Commune Veterans Association is a commune-level cadre.
Article 19 of Decree No. 33/2023 stipulates the leadership allowance for the Chairman of the Commune Veterans Association at 0.15.
"The Decree takes effect from August 1, 2023, but I have not yet received leadership allowances. I asked a professional agency and was told that I was waiting for instructions. So I would like to ask what I should do if I want to receive the above allowance?" - Mr. Quoc wondered.
Regarding Mr. Quoc's reflection and recommendation, the Ministry of Home Affairs responded on the Electronic Information Portal.
Pursuant to Clause 1, Article 16 and Clause 4, Article 19 of Decree No. 33/2023 of the Government regulating commune-level cadres, civil servants and part-time workers at the commune level, in villages and residential groups, the Chairman of the Commune-level Veterans Association is allowed to be classified as an administrative civil servant with the same training level and receive a leadership allowance of 0.15.
At the same time, Clause 4, Article 40 of this Decree has assigned the Provincial People's Committee to arrange, guide and inspect the use of funding sources to implement the regime and policies for commune-level cadres, civil servants, part-time workers at the commune level, in villages and residential groups and people directly participating in activities in villages and residential groups according to the provisions of this Decree.
Based on the above regulations and according to the decentralization of authority to manage cadres, the Ministry of Home Affairs requests Mr. Quoc to send the content of the petition to the People's Committee of Bac Ninh province for consideration and resolution according to his authority.
