Strong innovation in legislative work
At the 8th Session of the 15th National Assembly, General Secretary To Lam delivered an important speech that strongly expressed the spirit of transforming the thinking of law-making, frankly pointing out that among the three biggest bottlenecks today, namely institutions, infrastructure and human resources, institutions are the “bottleneck” of “bottlenecks”. This raises the need for strong innovation in legislative work, including innovation in the process of law-making and implementation.
At the same time, at this session, Politburo member and National Assembly Chairman Tran Thanh Man also gave instructions on Innovation in thinking in law-making, in which he requested that agencies assigned to draft, National Assembly agencies, and National Assembly deputies immediately implement innovative solutions to further improve the quality and speed up the progress of building and promulgating laws and resolutions of the National Assembly.
Delegate Nguyen Quang Huan - National Assembly Delegation of Binh Duong Province - said that the law-making mindset has been clearly demonstrated from the beginning of the term in Conclusion 19-KL/TW in 2021 on the orientation of the Law-making Program for the 15th National Assembly term. Conclusion 19-KL/TW affirmed the spirit of not building framework laws or pipeline laws.
To change the mindset of law making, delegate Nguyen Quang Huan said that it is necessary to change from the drafting agency, reviewing which contents in the decrees and circulars are not included in the law.
When drafting a draft law, it is necessary to adhere to Conclusion 19-KL/TW, not to develop a framework law or a pipeline law. Next, the role of the reviewing agency, the Nationalities Council and the National Assembly Committees, is to continue reviewing and recommending that the drafting agency make amendments in accordance with the new policy, to overcome the current situation of too long laws.
Many important results
Looking back over the past year, in 2024, legislative work achieved very important results, especially noting the innovation in thinking about law-making to ensure effective state management, encourage innovation, and liberate all productive forces... Therefore, the laws promulgated are concise, substantive, and correctly and sufficiently regulate issues under the authority of the National Assembly, ensuring stability and long-term value.
The number of laws and resolutions passed in 2024 is the highest since the beginning of the term, with 31 laws and 42 resolutions (accounting for nearly 50% of the total number of legislative tasks completed since the beginning of the term), including 8 legal normative resolutions, highly approved by the majority of National Assembly deputies.
In the 8th Session alone, the 15th National Assembly passed 18 laws, nearly one-third of the total number of laws passed since the beginning of the term. Of which, the legislative technique of "using one law to amend many laws", passed according to the 1-session process, was applied when issuing 1 law amending 4 laws in the investment field and 1 law amending 9 laws in the finance and budget fields.
This demonstrates the great efforts and determination of the National Assembly and the Government to promptly amend and supplement mechanisms and policies to meet urgent practical requirements; contribute to overcoming institutional "bottlenecks", promote the country's socio-economic development, and ensure the correct implementation of the spirit of innovation in law-making thinking.
Delegate Tran Hoang Ngan - Ho Chi Minh City National Assembly Delegation affirmed that the work of building laws in the direction of promoting decentralization and delegating power to local authorities for decision-making and local responsibility is appropriate.
In the coming time, it is necessary to continue institutional reform, reflecting urgent practical requirements, and supplementing the legal system to mobilize resources for national development.
Sharing the same view, delegate Nguyen Thi Thuy - National Assembly Delegation of Bac Kan - said that in order to innovate thinking in law-making, we must resolutely abandon the mindset of "if you can't manage it, then ban it" as General Secretary To Lam requested. Accordingly, we must strongly decentralize and delegate power in the direction of "locality decides, locality acts, locality takes responsibility".
Along with that, in 2025, the National Assembly and the Government need to identify the key task of reviewing, detecting and removing bottlenecks, thereby having a legal basis and legal tools for us to implement and remove them in practice.
