Speaking at the meeting, Chairman of the Committee for Science, Technology and Environment Le Quang Huy affirmed that the amendment of the Law this time must ensure constitutionality, legality and consistency with relevant legal documents, especially in the context of Vietnam strongly promoting the goals of energy conversion, digital transformation and sustainable development.
There are still many shortcomings after 15 years of implementation
According to Deputy Minister of Industry and Trade Nguyen Hoang Long, after 15 years of implementation, the Law on Energy Efficiency and Savings ( promulgated in 2010) has revealed many limitations, no longer keeping up with practical requirements, especially in the context of Vietnam implementing its commitment to achieve net zero emissions by 2050.
Currently, the world is applying tools such as carbon tax, border carbon adjustment mechanism (CBAM), green labels, carbon passports, etc. This puts great pressure on Vietnam's export goods, Deputy Minister Nguyen Hoang Long emphasized.
According to Deputy Minister of Industry and Trade Nguyen Hoang Long, the Draft Law has amended, supplemented and completed 19 articles of the Law on Energy Energy and Effective. The Draft Law amending and supplementing a number of articles of the Law on Energy use economical and efficiency inheritance of 30 things are kept in a total of 12 chapters and 48 articles of the 2011 Law.
The amendments to the addition of a number of articles of the Law on Energy use economical and efficiently focus on building tools to support businesses in technical and financial; Cut down administrative procedures, enhance decentralization of decentralization and promote the conversion of energy efficiency market. The draft Law amended and supplemented will cut down 02 administrative procedures (50%reduction rate), including: cutting procedures for issuing energy labeling certificates: transferring from certificates to self -publication, energy labeling; Cut the procedures for granting energy audit certificates. The reform of administrative procedures has met the guidance requirements of the competent authority, which reduces at least 30% of the time for handling administrative procedures.
Suitable conditions to submit to the National Assembly Standing Committee for consideration
Speaking at the meeting, Vice Chairman of the Committee for Science, Technology and Environment Nguyen Phuong Tuan said that the Standing Committee of the Committee agreed with the necessity of amending and supplementing a number of articles of the Law on Energy-saving and efficient Use.
Through research, the Standing Committee of Science, Technology and Environment Committee found that the Law Dossier is prepared seriously and basically meeting the requirements of Article 64 of the Law on Promulgation of Legal Documents, eligible to submit to the Standing Committee of the National Assembly for consideration before submitting to the National Assembly at the 9th session.
However, the Standing Committee of the Committee requested the drafting agency to continue reviewing and evaluating each content in 04 policies with the provisions of the Draft Law to ensure synchronization; The revised contents meet the practical requirements of the state management and international integration requirements.
Regarding the State's policies on economical and efficient use of energy (Clause 2, Article 1 of the Draft Law): Standing Committee of Science, Technology and Environment Committee realizes that Vietnam is currently in the process of industrialization and modernization, sustainable development of the country is closely associated with national energy security, so ensuring the demand for energy for fast and sustainable economy, national security and social order, national security and maintenance. People have a particularly important role and role. Therefore, the Standing Committee of Science, Technology and Environment Committee basically agreed with the amendment and supplementation of the contents of the State's 03 policies on the use of economical and efficient energy in the Draft Law as Clause 2, Article 1 of the Draft Law.
Regarding the strategy, planning and program of using energy (Clause 3, Article 1 of the Draft Law): The Standing Committee of Science, Technology and Environment Committee agreed with the implementation of economical and efficient use of energy, it is necessary to mobilize external financial resources from the state budget that also has socialized capital. However, there is an opinion that the addition of Clause 3 on resources for economical and efficient use of energy in the provisions of the strategy, planning and program of using energy is not reasonable; Determining the resources here are financial resources. Therefore, the Standing Committee of Science, Technology and Environment Committee proposes to consider, consider and adjust accordingly.
Ms. Nguyen Thi Lam Giang - Director of the Department of Innovation, Green Transformation and Industrial Promotion (Ministry of Industry and Trade) said that the draft revised Law will create an important legal foundation to promote investment in clean technology, saving energy, thereby helping businesses improve their competitiveness in the context of extensive international integration.
Concluding the meeting, the Chairman of the National Assembly of Science and Technology Committee Le Quang Huy affirmed: The conditions to ensure the dossier to submit to the Standing Committee of the National Assembly have guaranteed; Proposing the Ministry of Industry and Trade to advise the Government to supplement a number of draft documents guiding law enforcement.
It is expected that the Project to amend and supplement a number of articles of the Law on Energy Efficiency and Savings will be submitted to the National Assembly for consideration and approval at the 9th Session of the 15th National Assembly taking place in May 2025.
