On the morning of May 14, giving comments at the discussion session on the draft Law on Organization of Local Government (amended), delegate Nguyen Thi Hong Hanh (Ho Chi Minh City Delegation) was interested in regulations on decentralization and delegation of authority.
Delegates said that the draft has absorbed and added many positive points, including the provincial People's Council as the subject that is decentralized and authorized; The Chairman of the People's Committee of the commune may authorize civil servants of the People's Committee, especially judicial officials in the field of authentication.
However, compared to the current regulations, there is still a shortage of Chairman of the People's Committee that authorizes the Vice Chairman of the People's Committee. Therefore, the delegate proposed to supplement the content of the Chairman of the People's Committee may authorize the Vice Chairman of the People's Committee.
Regarding the provisions of the case of the Chairman of the provincial People's Council as a specialized People's Council representative, the provincial People's Council has 1 Vice Chairman of the People's Council; In case the Chairman of the provincial People's Council is a part -time People's Council delegate, the provincial People's Council has 2 vice presidents.
The delegate of the Ho Chi Minh City Delegation stated that this regulation was developed in the context of a 3-level government model and has not yet merged provincial-level administrative units.
However, from July 1, when the merger is implemented, many localities, especially centrally-run cities and supermarkets, will have a large population size and conditions for socio-economic development.
Therefore, the regulation of the number of Vice Chairmen of the provincial People's Council is the same across the country from 1-2 people is not consistent with the new reality. At the same time, this content has not been agreed with the provisions of the number of Vice Chairman of the People's Committee, assigning the Government to stipulate the frame of the Vice Chairman of the provincial People's Committee, ensuring consistent with the size and characteristics of each administrative unit.

Sharing opinions on this draft law, delegate Trinh Xuan An (Dong Nai delegation) proposed to continue reviewing and revising regulations on specific tasks and powers of People's Councils, People's Committees, and Chairmen of People's Committees to clarify the policy of promoting decentralization and delegation of power, ensuring a reasonable division of tasks and powers of local authorities at the provincial and commune levels.
However, the delegate suggested that the control mechanism and the accountability of the People's Committee should be further clarified.
In particular, it is necessary to increase the number of full-time National Assembly deputies and supervision activities of local People's Councils.
Delegates stated that at present, the duties of the People's Committee are very large. Without strengthening the supervision mechanism of the People's Council, especially strengthening the number of specialized National Assembly deputies will be very difficult to promote the rights and obligations of the elected agency.
To enhance the effectiveness and efficiency of state management, promote socio-economic development, and protect the legitimate rights of the people, the People's Committee at the provincial level directly performs the duties of its subordinates.
According to the delegate, it is necessary to clarify when necessary that they are cases for socio-economic development, ensuring the rights of the people. In these necessary cases, there should also be limits on when the "handshake" of work will end.
