The Government has just issued Decree No. 116/2024/ND-CP amending and supplementing a number of articles of Decree No. 138/2020/ND-CP dated November 27, 2020 regulating the recruitment, use and management of civil servants and Decree No. 06/2023/ND-CP dated February 21, 2023 regulating the quality assessment of civil servant input.
One of the contents that receives the attention of many people is the regulations related to the recruitment, use and management of civil servants.
The new Decree amends Article 42 of Decree No. 138/2020/ND-CP dated November 27, 2020 regulating the recruitment, use and management of civil servants.
Accordingly, the standards and conditions for appointment are: Ensuring general standards according to the regulations of the Party and the law and specific standards of the appointed position and title according to the regulations of the competent authority;
For personnel from local sources, they must be planned for the appointed position or title or be planned for an equivalent position or title or higher. For personnel from other sources, they must be planned for an equivalent position or title or higher. Special cases shall be considered and decided by competent authorities;
In case a newly established agency, organization or unit has not yet approved the planning, the competent authority shall consider and decide;
Have held the position, title or equivalent position, title for at least 02 years (24 months), if not consecutive, it can be accumulated (only accumulated for the time holding the position, equivalent title) or ensure continuous working time in the industry, field according to the specific standards of the appointed position, title. Special cases will be considered and decided by the competent authority;
Have verified personal records and background, have a declaration of assets and income according to regulations;
Regarding age requirements for appointment, the new Decree clearly states:
Civil servants proposed for the first time to hold a leadership or management position or title, or proposed to hold a higher leadership or management position or title, must be of age to serve the entire term of appointment. The time for calculating the age of appointment shall be implemented according to the regulations of the competent authority. Special cases shall be considered and decided by the competent authority;
Civil servants appointed to a new position or title equivalent to or lower than the current position or title shall not be considered for appointment age according to regulations;
Be healthy enough to fulfill assigned duties and responsibilities;
Not in cases of being banned from holding positions; not being under disciplinary action; not being under prosecution, investigation, prosecution, or trial; not being subject to disciplinary regulations according to Party regulations and the law.
