Decree No. 283/2025/ND-CP dated October 31, 2025 of the Government amending and supplementing a number of articles of Decree No. 120/2020/ND-CP regulating the establishment, reorganization and dissolution of public service units takes effect from November 1, 2025.
Notably, Decree 283/2025/ND-CP has added regulations on the transfer of public service units.
Accordingly, the transfer of public service units is the transfer of management authority for public service units between management agencies or decentralization of public service unit management. The transfer of public service units is carried out according to the principle of transferring the status quo of public service units.
The Decree also specifically stipulates the authority to decide on the transfer of public service units:
The Prime Minister decides on the transfer of public service units between ministries, ministerial-level agencies, and agencies under the Government (except for public service units under the organizational structure of ministries, ministerial-level agencies, and agencies under the Government); between ministries, ministerial-level agencies, and agencies under the Government with provincial People's Committees and between provincial People's Committees.
Ministers, heads of ministerial-level agencies, and heads of Government agencies decide on the transfer of public service units between organizations, units under ministries, ministerial-level agencies, and agencies under the Government.
The Provincial People's Committee decides on the transfer of public service units between other specialized agencies and administrative organizations under the Provincial People's Committee; between other specialized agencies and administrative organizations under the Provincial People's Committee with the Commune People's Committee and between the Commune People's Committees.
