Decree 283/2025/ND-CP amends and supplements Decree 120/2020/ND-CP stipulating the authority and responsibility of the Provincial People's Committee, Chairman of the Provincial People's Committee, and Commune People's Committee, effective from November 2025.

Decree 120/2020/ND-CP stipulates that public service units under the management of the Provincial and Municipal People's Committees include: Public service units under the Provincial People's Committee; public service units under specialized agencies under the Provincial People's Committee; public service units under branches and equivalents under departments; public service units under other administrative organizations under provincial People's Committees...
The Provincial People's Committee decides to establish, reorganize, and dissolve the above public service units (except for units under the authority to decide on the establishment of the Government, the Prime Minister, and Ministers managing sectors and fields as prescribed by specialized laws) and other public service units as prescribed by law.
Notably, Clause 3, Article 5 of Decree 120/2020/ND-CP is supplemented by Clause 2, Article 14 of Decree 283/2025/ND-CP stipulating the conditions for dissolving public service units.
The public service unit shall be dissolved in cases where at least one of the following conditions is met:
First, there are no longer functions or tasks of providing public service, serving state management;
Second, not meeting the criteria for establishing a public service unit as prescribed by law;
Third, 3 consecutive years of ineffective operations according to the assessment of competent authorities;
Fourth, implement according to the national sectoral planning or the network planning of public service units (if any) approved by competent authorities;
Fifth, for public service units abroad, in addition to meeting one of the conditions specified in Points a, b, c, d, Clause 3, Article 5 of Decree 120/2020/ND-CP, it is necessary to ensure compliance with the foreign policies of the Party and State and the agreement between the Government of the Socialist Republic of Vietnam and the Government of the host country on the dissolution of public service units.
