Continuing the 9th session, on the morning of May 21, the National Assembly heard the Chairman of the Central Committee of the Vietnam Fatherland Front presented the report on the Law on amending and supplementing a number of articles of the Vietnam Fatherland Front Law, Trade Union Law, Youth Law and the Law on Execution of the grassroots level.
Continue to affirm the irreplaceable position of the Vietnam Trade Union
The draft Law has amended and supplemented 09/37 articles of the 2024 Trade Union Law. The amended and supplemented content focuses on regulations on the position, role and organization of the Trade Union; the right to propose law making, supervision activities of the Trade Union; management and use of trade union finance and assets.
The draft Law continues to affirm the important and irreplaceable position of Vietnam Trade Union.
Accordingly, the draft Law adds to Article 1 of the 2024 Trade Union Law the regulation of "being a member organization directly under the Vietnam Fatherland Front" and "representing workers at the national level in labor relations and international relations with trade unions" to specify the provisions in Article 10 of the 2013 Constitution (amended).
The content of amendments and supplements also ensures consistency with the Vietnam Fatherland Front Law (amended), in accordance with the role and position of the Vietnamese Trade Union is "the largest representative organization, focusing on the collection and solidarity of the working class and workers nationwide".
At the same time, Article 10 of the 2013 Constitution (amended) and the draft Law amending and supplementing Article 1 of the Trade Union Law continue to affirm that the Trade Union is a socio-political organization of the working class and laborers, representing and protecting the rights of union members and laborers;
Affirming the important and irreplaceable position of the Vietnam Trade Union in labor relations, representing the working and laborers.
When arranged and directly under the Vietnam Fatherland Front, the Vietnam Trade Union still has legal status, the seal of the organization, still represents and participates in international labor relations, participates in labor relations and protects the rights of workers, in accordance with international commitments on labor of which Vietnam is a member.
Vietnam Trade Union at all levels
The draft Law abolishes the regulation on trade unions at the grassroots level " trade unions at the grassroots level", "district-level labor unions" and the corresponding and specific authority of the trade union organization.
Amend and supplement regulations at all levels of trade unions, including: central level is the Vietnam General Confederation of Labor;
The grassroots trade unions include provincial and central trade unions, economic group trade unions, general corporation trade unions, and specialized grassroots trade unions permitted by competent authorities in accordance with the trade union organization;
Grassroots trade unions include grassroots trade unions and grassroots trade unions.
According to the drafting agency of the Law, the above regulation aims to organize trade unions that are not purely administrative, not associated with residential areas, mainly in enterprises and industry trade unions, and are organized in an open and flexible manner according to the characteristics of the trade union organization.
At the same time, in the draft Law, the provisions on attending meetings, meetings, meetings and conferences of the Chairmen of the grassroots trade unions are amended; adjusting the responsibility of the grassroots trade unions in developing union members, grassroots trade unions, and grassroots trade unions when there are no more direct grassroots trade unions and district-level labor federations.
Regarding the right to propose the construction of laws and supervision activities of the Trade Union, the law project has amended and supplemented Article 13 of the 2024 Trade Union Law in the direction of abandoning the authority to submit the Law of the Vietnam General Confederation of Labor to comply with Clause 1, Article 84 of the Constitution (amended).
