On the afternoon of July 27, the National Assembly Standing Committee gave opinions on the draft Law amending and supplementing a number of articles of 9 laws on military and national defense.
General Phan Van Giang - Member of the Politburo, Deputy Prime Minister, Minister of National Defense - said that the development of the draft law aims to institutionalize the Party's policy on national defense and security.
At the same time, continue to streamline the organizational structure of the political system, operate effectively and efficiently; promote decentralization, delegation of power and complete local defense organizations.
The draft law focuses on amending regulations related to the organizational structure, authority and handling of issues arising after implementing the 2-level local government model.
Draft Law amending and supplementing a number of contents of 9 laws on military and national defense.
Accordingly, amendments and supplements to a number of articles of the Law on Officers of the Vietnam People's Army include: Regulations on cadre positions of Commands of provincial-level military commands, commune-level military commands; the highest service age limit for some titles and the appointment of positions in reserve units.
At the same time, amend and supplement a number of articles of the Law on Professional Military Personnel, workers and national defense officials such as: Regulations on the rank of reserve professional soldiers.
The draft also amends and supplements a number of articles of the Law on Military Service such as: Regulations on handling acts of evading military service; acts strictly prohibited of fraud in military health checks; reserve rank demotion.
Organize the handover of citizens called to enlist; hand over non-commissioned officers and soldiers who have completed their military service; policies and regimes for citizens during the time of military service registration, preliminary selection, medical examination, and health check-up.
The draft law also amends and supplements regulations on building regional defense in the tasks of the Border Guard to be consistent with the dissolution of the Regional Defense Command.
Amending and supplementing a number of articles of the Law on People's Air Defense such as: Regulations on regional defense to be consistent with the reorganization of the Regional Defense Command; the decentralization and adjustment of authority from the Ministry of Industry and Trade to the Provincial People's Committees; the reduction of administrative procedures.
Amending, supplementing, and repealing a number of articles of the Law on Reserve Forces: Regulations on regional defense to be consistent with the reorganization of the Regional Defense Command.
According to General Phan Van Giang, the amendment of 9 laws mainly relates to organization, authority and legislative techniques, without generating new policies on regimes for people or new expenditures of the state budget.
Representing the thẩm tra agency, Senior Lieutenant General Le Tan Toi - Member of the Party Central Committee, Chairman of the National Defense, Security and Foreign Affairs Committee, said that the thẩm tra agency highly agreed with the necessity of promulgating the law.
Timely amendments to the laws are assessed to contribute to overcoming legal gaps when implementing 2-level local government, ensuring continuity in command, administration and performing military and national defense tasks in the locality.
Speaking at the meeting, Politburo Member, National Assembly Chairman Tran Thanh Man assessed that the draft law dossier was carefully prepared by the Ministry of National Defense and relevant agencies, basically meeting the conditions to be submitted to the National Assembly for consideration at the First Extraordinary Session.
The National Assembly Chairwoman requested the drafting agency to continue to review legislative techniques, ensuring synchronization and consistency between the 9 amended laws and the Law on Organization of the Government, the Law on Organization of Local Government and other specialized laws.
