The Government Inspectorate proposes cases to be amended and supplemented with inspection conclusions and recommendations.

On July 26, information from the Government Inspectorate said that this agency is seeking opinions on the draft Government Resolution stipulating the amendment and supplementation of inspection conclusions and recommendations.

In which, the draft Resolution proposes conclusions and inspection recommendations to be considered for amendment and supplementation when falling into one of the following cases:

1. Detecting errors in the process of issuing conclusions and inspection recommendations that affect the accuracy of the content of conclusions and inspection recommendations.

2. New details or new documents and evidence arise that affect the content of conclusions and inspection recommendations.

3. Legal regulations applied as a basis for issuing inspection conclusions and recommendations have changed, directly affecting the content of inspection conclusions and recommendations or the organization of the implementation of inspection conclusions and recommendations.

4. There is a conclusion, judgment, decision that has taken legal effect from a competent state agency or procedural agency that changes the legal basis or the actual basis of the conclusion or inspection recommendation.

5. Due to organizational structure arrangement, adjustment of administrative boundaries, changes in planning, changes in mechanisms and policies, or other objective reasons leading to inability to implement or no longer being suitable to continue to implement the entire or part of the inspection conclusions and recommendations.

6. Other cases according to the National Assembly's resolution or according to the provisions of law.

The draft Submission of the Government Inspectorate also stated that the practice of organizing the implementation of inspection conclusions in the past time shows that there are some cases of difficulties and obstacles that are not caused by non-compliance with inspection conclusions, but due to changes in policies and laws; changes in planning, socio-economic conditions; organizational structure arrangement; or the discovery of new details and documents that may change the basis for applying the law or the content of handling recommendations.

In addition, there are inspection conclusions issued in the context that the legal system is still overlapping, unconsistent, or has later been amended and supplemented in a direction different from the legal basis at the time of issuing the conclusion.

In these cases, if the inspection conclusion is continued in its original state, it may lead to difficulties in organization of implementation, affecting the effectiveness of state management, the legitimate rights and interests of the State, organizations, individuals, as well as the implementation of socio-economic development policies.
