On the afternoon of September 24, the National Assembly Standing Committee gave its opinion on the draft Law on Employment (amended). The latest draft law submitted to the National Assembly Standing Committee proposed new regulations on part-time employment of students studying in formal education programs.
Accordingly, workers who are students studying in formal education programs and are of working age according to the provisions of this draft law are allowed to work according to the provisions of the law on labor.
The salary of students is paid based on the agreement between the employee and the employer but must not be lower than the minimum hourly wage.
Students who work part-time are responsible for notifying the educational institution.
Also according to the draft law, employers are responsible for employing students in accordance with labor laws. Educational institutions and families are responsible for monitoring and supporting student workers during their work.
Previously, presenting the Government's proposal on the draft Law on Employment (amended), Minister of Labor, War Invalids and Social Affairs Dao Ngoc Dung said that the draft law has many contents to reform unemployment insurance policies.
The draft law adds the following participants: employees with a fixed-term labor contract of 1 month or more (currently 3 months or more). Part-time employees with monthly salaries equal to or higher than the lowest salary used as the basis for compulsory social insurance contributions.
Notably, the unemployment insurance contribution rate is also flexibly regulated in the direction that employees contribute a maximum of 1% of their monthly salary. Employers contribute a maximum of 1% of the monthly salary fund of employees participating in unemployment insurance.
The State supports up to 1% of the monthly salary fund for unemployment insurance contributions of employees participating in unemployment insurance and is guaranteed by the central budget.
The draft law also amends unemployment insurance regimes. Employers are supported in cases of economic reasons, changes in structure and technology as prescribed in the Labor Code; natural disasters, fires, enemy attacks or dangerous epidemics or implementation of decisions of competent State agencies on relocation or reduction of production and business locations...
Reporting on the review of the draft law, Chairwoman of the National Assembly's Social Committee Nguyen Thuy Anh said that the Standing Committee of the Committee requested the drafting unit to supplement the impact assessment. At the same time, there should be solutions to ensure feasibility when expanding the subjects participating in unemployment insurance.
In addition, it is necessary to clarify the mechanism for handling late payment and evasion of unemployment insurance.
