Continuing the 9th Session, on the afternoon of May 29, the National Assembly discussed in the hall the draft Law amending and supplementing a number of articles of the Law on Vietnamese nationality.
The majority of National Assembly deputies expressed their high agreement on the necessity of promulgating the Law with political, legal and practical bases.
At the same time, the adjustment to concretize the Party's policy in Resolution 36 of the Politburo on overseas Vietnamese work in the new situation, the Directive 40 and 45 of the Central Executive Committee, as well as Resolution 57 of the Politburo on science and technology development, innovation and digital transformation.
However, to contribute to the completion of the draft Law, the delegates suggested that the drafting agency review some contents.
Delegate Nguyen Lam Thanh - National Assembly Delegation of Thai Nguyen province participated in giving comments and suggested that it is necessary to expand the issue of Vietnamese people having 2 nationality.
According to the delegate, there are currently about 6 million overseas Vietnamese, while the Party and State are in the process of attracting overseas Vietnamese intellectuals and intellectuals to contribute to the country.
"We Vietnamese people live in many countries, many developed countries, and are contributing in important positions in economic development in those countries. So that they can be ready to return to Vietnam, opening a legal corridor is completely appropriate", delegate Nguyen Lam Thanh shared.
Regarding the issue of naming when naturalizing, the draft Law stipulates that the person applying for Vietnamese nationality must have a name in Vietnamese or other ethnic languages of Vietnam. The name was chosen by the Vietnamese citizen application and was clearly stated in the Decision on Vietnamese naturalization.
Delegate Nguyen Lam Thanh said that this is not necessary. According to the delegates, some countries in the world stipulate that they only need the element of that country, some other countries need to have the element of the country that wants to be naturalized and the element of their country was born, just hearing the name can know where the source of that person is.
For example, Martin Nguyen or Robetto Tan, it does not necessarily have to be Vietnamese. Recently, there have been many naturalized players, such as Rafaelson Bezerra Fernandes, so we have changed their name to Nguyen Xuan Son, we cannot identify the origin of naturalized people," said delegate Nguyen Lam Thanh.
Agreeing with the above opinion, delegate Nguyen Van Than - National Assembly Delegation of Thai Binh province said - "Why does it not stipulate that people have to change their names to Vietnamese, even foreign names? For example, player Nguyen Xuan Son. If people have a wish, it is their job, not a must".
Commenting on the draft Law, delegate Do Thi Viet Ha - National Assembly Delegation of Bac Giang province suggested that it is necessary to specify more clearly the condition "can return to Vietnamese nationality".
Accordingly, Point b, Clause 7, Article 1 of the draft Law stipulates the conditions for returning to Vietnamese nationality, which stipulates that "A person who has lost his/her Vietnamese nationality as prescribed in Article 26 of this Law and has submitted an application to return to Vietnamese nationality can return to Vietnamese nationality".
The delegate said that the use of the phrase "may" lead to an emotional understanding, which is not consistent with the name "condition to return to Vietnamese nationality".
Therefore, the delegate proposed to consider and amend in the direction of specifically stipulating the conditions for "may" return to Vietnamese nationality right in the Law or amend in the direction of replacing the phrase "may" with the phrase "reviewed and decided".
