On September 30, the 8th National Assembly Delegation Conference continued to discuss a group of economic and financial sectors, including the following laws: Law on Bankruptcy (amended); Law on Deposit Insurance (amended); Law on E-commerce; Law on Savings and Combat of Wastefulness.
Speaking at the meeting, full-time delegate of the National Assembly Delegation (NAD) of Lam Dong province Trinh Thi Tu Anh proposed to add regulations that e-commerce platforms and livestream platforms must take primary responsibility for compensation for damages in cases where products promoted through payment for display priority are determined to be counterfeit or harmful.
According to delegate Trinh Thi Tu Anh, this regulation will create strong financial incentives, so that platforms screen content more carefully, instead of letting poor quality goods be publicly sold.
In addition, it is necessary to require platforms to have a mechanism to publicize information about products and sellers, including origin, quality... before the transaction is completed. This not only increases transparency but also helps consumers make wise shopping decisions, minimizing the risk of being scammed.
Regarding the mechanism for dispute resolution, delegate Trinh Thi Tu Anh said that the complaint system is too complicated, putting consumers at a disadvantage when facing large enterprises.
To overcome this, it is necessary to establish a specialized electronic commercial dispute resolution agency or build an electronic refereeing system with simple procedures, low costs and the ability to quickly enforce decisions. This helps consumers easily protect their rights without being obstructed by administrative barriers" - delegate Tu Anh suggested.
At the same time, it is necessary to supplement regulations on litigation in e-commerce, allowing a large group of consumers to file a lawsuit to request compensation for damages from violating platforms.
This mechanism will enhance legal strength, create a balance between consumers and industrial groups, ensure that serious violations will be handled appropriately.
According to the principle of inter-related legal responsibility, the determination of responsibility between parties - including commercial platforms, livestreamers and suppliers - is the foundation for applying the incentive regime. Currently, responsibility is being dispersed, leading to a situation of evasion of duty.
Delegate Tu Anh added that platforms with the role of controlling IT and content posting processes must take joint responsibility if they do not act promptly when receiving warnings about violations, such as false advertising or fake products.
They cannot use the excuse of being an intermediary to exploit responsibility, because the payment they design has a direct impact on the content of received consumers. Therefore, it is necessary to clearly stipulate that platforms must be transparent in key parameters, especially factors related to advertising distribution and displaying sales content" - delegate Tu Anh said.
Another problem, according to delegate Trinh Thi Tu Anh, controlling hundreds of thousands of livestream sessions per day is a big challenge, not only in terms of technology but also in terms of the ability to enforce the law.
To resolve this, it is recommended to transfer part of the primary monitoring obligation to platforms, requiring them to deploy a system to automatically detect and prevent violations, such as fraudulent advertising content or fake products.
The management agency will shift to the role of supervising compliance with the self-control process of platforms, ensuring that they strictly fulfill their obligations and can integrate with the VNeID system - Lam Dong delegate suggested.
