On the morning of September 22, the National Assembly Standing Committee gave its opinion on the draft Law on E-commerce. The draft law is designed to include 8 chapters and 50 articles.
Deputy Minister of Industry and Trade Nguyen Sinh Nhat Tan presented a report on this bill.
Notably, the draft has introduced many new regulations to manage e-commerce activities. Including regulations on common groups of responsibilities of entities participating in e-commerce activities.
Regarding regulations related to information transparency, according to the draft law, e-commerce platforms must ensure that information is published publicly and transparently, including information about owners.
Along with that, it is necessary to ensure information about the seller, which is a new point compared to the decree, displaying the seller's information; information about products, goods, services; general transaction conditions, including the rights and obligations of the parties, delivery policies, payments, dispute resolution mechanisms, etc.
In particular, the draft stipulates the "identification of sellers". In which the platform's owner is responsible for identifying domestic sellers via VNeID. Identify foreign sellers through documents proving legality.
Along with that, regulations on controlling information that violates the law. Specifically, the preventive measure is to have an automatic information censorship mechanism before displaying it on the platform. Review and remove information that violates the law when detecting or receiving feedback.
For livestream sales activities, the draft clearly stipulates that platform owners must authenticate the identities of livestreamers, publicize and implement real-time control mechanisms and measures for livestream sales content.
The seller must provide livestreamers with legal documents proving that they meet the conditions.
For livestreamers, the bill clearly stipulates that they must not provide false or confusing information about their uses, origin, quality, prices, promotions, warranty policies and other contents related to goods and services.

manufacture advertising content that has been confirmed by competent authorities for goods and services that are subject to legal regulations and must confirm advertising content.
Regarding affiliate marketing activities, the draft clearly states that organizations providing affiliate marketing services must identify affiliate marketers; have a mechanism to monitor and supervise the activities of affiliate marketers.
For affiliated marketers, the bill clearly states that they must not provide false or confusing information about the uses, origin, quality, prices, promotions, warranty policies and other contents related to goods and services.
Link marketing cannot be carried out on digital platforms that do not meet the operating conditions in Vietnam.
Presenting the review report, Chairman of the Economic and Financial Committee Phan Van Mai said that the Standing Committee of this Committee agreed to continue perfecting the legal framework on e-commerce.
However, the Standing Committee of the Economic and Financial Committee believes that in order to better protect consumer rights, prevent tax losses, control the problem of counterfeit goods, etc., it is necessary to improve the overall implementation of relevant legal regulations and improve the effectiveness of law enforcement.
Therefore, the reviewing agency proposed to report additional information to clarify the shortcomings, limitations, and "spaces" in current laws and draft laws that are being submitted to the National Assembly at the same time, which need to be overcome, supplemented, and perfected by separate regulations in the draft Law on E-commerce.
