Inspectors point out violations in civil servant recruitment in Bac Lieu

The Inspectorate of the Ministry of Home Affairs pointed out cases of recruitment into civil service positions that were not in accordance with regulations in Bac Lieu in Inspection Conclusion No. 58/KL-TTBNV.

Reflecting on the Ministry of Home Affairs' electronic information portal, Mr. Nguyen Van Thanh (character's name has been changed) said that recently, the place where he worked (Department of Planning and Investment of Bac Lieu province) had a number of cases of recruitment that violated regulations as pointed out by the conclusion of the Ministry of Home Affairs Inspectorate (there should have been an exam but the province conducted the recruitment).

Since then, the wrongly recruited civil servants have not received regular salary increases, because Bac Lieu province has not had a recruitment plan and currently these civil servants are still working and performing normal duties like other civil servants.

According to the opinion of the Department of Home Affairs of Bac Lieu province, for cases of incorrect recruitment according to the conclusion of the Inspectorate of the Ministry of Home Affairs, it is recommended to delay the salary increase until the results of the re-examination are available, then re-propose (attached to Official Dispatch No. 459/SNV-CCVC dated May 2, 2024 of the Department of Home Affairs of Bac Lieu province).

Mr. Thanh wondered if the conclusion of the Ministry of Home Affairs Inspectorate is a legal basis for delaying salary increases for civil servants, even though the violations in recruitment are not their fault.

"Does the delay in regular salary increases for the above-mentioned civil servants violate the provisions of Circular 03/2021/TT-BNV?" - Mr. Thanh shared.

He also expressed that this is the common mentality of civil servants who are in a situation where they do not know how to handle the situation to feel secure in their work.

Regarding Mr. Thanh's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

The Ministry of Home Affairs said that on January 31, 2024, the Inspectorate of the Ministry of Home Affairs issued Inspection Conclusion No. 58/KL-TTBNV in Bac Lieu province, which pointed out cases of recruitment into civil servants that were not in accordance with regulations and recommended that the People's Committee of Bac Lieu province, based on the provisions of current law and the total number of assigned positions, review recruitment needs, standards, conditions, and job positions to be recruited to organize recruitment exams in accordance with legal regulations.

According to the report of the People's Committee of Bac Lieu province and the content of his reflection on the Electronic Information Portal of the Ministry of Home Affairs, the Provincial People's Committee is currently implementing the recommendation according to the Inspection Conclusion of the Inspectorate of the Ministry of Home Affairs.

Regarding regular salary increase, based on Point a, Clause 3, Article 4, Circular No. 08/2013/TT-BNV dated July 31, 2013 of the Ministry of Home Affairs, the Chairman of the Provincial People's Committee has the authority to inspect and resolve difficulties in implementing the regular salary increase regime in the locality.
