Omissions and violations in construction permit issuance and construction order management
The Government Inspectorate has just issued Notice No. 1105/TB-TTCP, Notice of Inspection Conclusion on the compliance with legal regulations in land management and use and construction planning, construction permits in Hanoi city.
In which, the Government Inspectorate pointed out shortcomings and violations in the selection of investors to implement housing projects without bidding to select investors (European Overseas Vietnamese Village Project), without auctioning land use rights (D25* Cau Giay Tower Project; Ho Guom Plaza Trade Center, Office and High-Class Housing Project...), investment policy decisions not within authority (Trade, office and high-rise housing complex project at No. 01 Giap Nhi).
Omissions and violations in the issuance of construction permits and construction order management for 12 projects: Low-rise housing construction investment project in land plots from TT14 to TT19, Auction area of Trau Quy town; D25* Cau Giay Tower Project; Nam Thanh Low-rise Housing Area Project; Artemis Commercial Center, Office, Apartment Project; General Commercial and Service Center and High-rise Housing Project in Tu Hiep commune; Commercial, Cultural and Sports Service, Housing and Office for Rent Complex Project at land plot 493 Truong Dinh; Dai Kim New Urban Area Project; Commercial Service, Public, High-rise Apartment Housing, Greenery, Parking Lot and Kindergarten - Panorama Hanoi Project; Ho Guom Plaza Commercial Center, Office and High-Class Housing Project; Commercial Service and High-Class Apartment and Low-rise Housing Complex Project in La Khe and Duong Noi wards; Van Khe Expanded Urban Area Project; Commercial Service and High-Class Apartment and High-Class Apartment Complex and High-Class Apartment and High-Class Housing Project in Ho Chi Minh City.
By the time of inspection, there were 2 projects where the investor still owed land use fees (Nam Thanh low-rise housing project; Van Khe expanded urban area project).
5 projects are behind schedule according to regulations compared to the approved progress (Thanh Lam - Dai Thinh 2 New Urban Area Project; Ha Dinh New Urban Area Project; General Trade and Service Center and High-rise Housing Project in Tu Hiep commune; Van Khe Urban Area Expansion Project; Phu My Housing Area Project).
Transfer to the investigating agency if there are signs of criminal law violations
From the inspection results, the Government Inspector General proposed that the Prime Minister consider and direct the Hanoi People's Committee to develop a plan to concretize the implementation of Resolution No. 73/NQ-CP and Resolution No. 116/NQ-CP of the Government, including inspection and review of land use plans, procedures for land allocation, land lease, and issuance of land use right certificates for enterprises after equitization in the area, to thoroughly handle existing violations (if any) to ensure the rights of land users and land use efficiency.
Hanoi City People's Committee organizes self-criticism to clarify responsibilities and handle them according to its authority or propose to competent authorities to handle them according to regulations; and at the same time direct the Heads of relevant agencies, units, and localities to conduct self-criticism and clarify the responsibilities of organizations and individuals for the limitations, shortcomings, and violations mentioned in this Inspection Conclusion to handle them in accordance with regulations.
Organize the implementation of inspection conclusions; take measures to rectify, overcome, and handle limitations, shortcomings, and violations in land use management, construction planning, construction permits, and construction order management as stated in this inspection conclusion.
In the process of implementing the Inspection Conclusion, detecting causing loss to the State budget, showing signs of criminal law violations, transfer them to the Investigation Agency for handling according to the provisions of law.
