Government Inspectorate proposes Tan Mai Group JSC to thoroughly remedy land violations

The Government Inspectorate proposed that Tan Mai Group Joint Stock Company (JSC) handle and thoroughly remedy violations, strictly comply with land regulations.

Regarding the Notice of Inspection Conclusion on the management and use of land originating from agricultural and forestry companies under Vietnam Paper Corporation in the Central Highlands provinces, the Government Inspectorate has made a number of handling recommendations.

In which, at Tan Mai Group JSC, Vietnam Paper Corporation still holds 22.73% of capital (this capital is the state capital retained after equitization).

The Government Inspectorate clearly pointed out the management and use of land by CTCPT Tan Mai Group in Dak Lak, Dak Nong, Lam Dong provinces (before the arrangement of provincial-level administrative units):

- Not yet reviewing the current status of land use, developing land use plans, clearly determining the area and boundaries according to the provisions of Clause 2, Article 133 of the 2013 Land Law; the management and use of land is still loose, so far the area encroached upon and encroached upon by people is large, which is not in accordance with regulations: Dak Lak province, area 2,476.595ha; Dak Nong province, area 1,011.64ha; Lam Dong province, area 492.041ha, it is necessary to have management and protection measures from units and the involvement of local authorities to stabilize the security and order situation in the area.

- Using leased land not in accordance with the law, not implementing afforestation, still leaving vacant land with a large area, violating Article 15 of the 2003 Land Law, Clause 3, Article 12 of the 2013 Land Law: in Dak Lak province, area 1,553.4ha; in Dak Nong province, area 808.17ha; in Lam Dong province, area 69.3ha.

- Have not carried out financial obligation procedures for 97.5ha of land in Bao Lam district (now Bao Lam 3 commune) and 560.55ha in Dam Rong district (now Dam Rong 2 and Dam Rong 3 communes).

The Government Inspectorate proposed that Tan Mai Group JSC handle and thoroughly overcome the limitations, shortcomings, and violations mentioned in the Inspection Conclusion; strictly comply with legal regulations on land management and use, forest protection and development; strengthen coordination with functional forces and local authorities, arrange patrol and inspection forces to promptly detect, prevent, and handle the situation of deforestation and illegal land encroachment;

Use leased land in accordance with the law; implement afforestation for areas of land that have not been put into use, in cases where there is no need to use, hand over to local management according to regulations;

Review and develop land use plans, clearly define boundaries and areas being used, strictly comply with the implementation of financial obligations for an area of 97.5ha in Bao Lam district (now Bao Lam 3 commune) and 560.55ha in Dam Rong district (now Dam Rong 2 and Dam Rong 3 communes).
