Inspection discovers violations in mineral exploitation licensing in some southern provinces

The Government Inspectorate pointed out many violations in the licensing of mineral exploitation in some southern provinces.

The Government Inspectorate has just publicly announced Inspection Conclusion No. 467/KL-TTCP dated July 18, 2026 on the specialized inspection of the management of exploration, surveying, planning, licensing, exploitation, and transportation of mineral deposits for construction materials in some provinces in the Southern region.

Previously, implementing Inspection Decision No. 656/QD-TTCP dated December 20, 2024 of the Government Inspector General, from January 13, 2025 to May 13, 2025, the Inspection Team conducted inspections at the People's Committees of Dong Thap, Binh Phuoc, Dong Nai and Ba Ria - Vung Tau provinces (before joining the province).

The Government Inspectorate pointed out some detected legal violations that need to be considered by competent authorities and have appropriate handling measures according to regulations.

Regarding the issuance of mineral exploration licenses:

Binh Phuoc Provincial People's Committee issued 6 mineral exploration licenses with a total area of 70.09ha not in accordance with the provisions of Clause 1, Article 78 of the 2010 Mineral Law.

By the time of inspection (March 2025), Binh Phuoc Provincial People's Committee had revoked decisions to supplement non-auction areas for 4/6 above-mentioned exploration licensed areas; the remaining 2 areas need to be handled in accordance with regulations.

The People's Committee of Ba Ria - Vung Tau province continued to issue exploration licenses at 2 construction stone mines with a total area of 30.39ha after the exploitation license issued before July 1, 2011 expired and expired according to the provisions of point b, clause 2, Article 58 of the 2010 Mineral Law, not in accordance with the provisions of clause 1, Article 84 of the 2010 Mineral Law.

Regarding mineral exploitation licensing

People's Committees of Binh Phuoc and Dong Nai provinces issued exploitation licenses in 5 construction stone areas and 1 construction sand area not in accordance with the policy and goal of zoning non-auction areas to supply projects using state budget capital.

People's Committees of Binh Phuoc and Dong Nai provinces issued exploitation licenses and extended exploitation licenses for 32 mineral mines supplied to the market, which is not in accordance with regulations.

The People's Committee of Ba Ria - Vung Tau province re-issued 2 construction stone mining licenses and extended 1 sand mine in areas licensed for mining from before July 1, 2011, but the license expired and expired according to the provisions of point b, clause 2, Article 58 of the 2010 Mineral Law, not in accordance with the provisions of clause 1, Article 84 of the 2010 Mineral Law.

According to the Government Inspectorate, the above-mentioned violations of the issuance and extension of mineral exploitation licenses by the People's Committees of Binh Phuoc and Dong Nai provinces have led to a large volume of mineral resources being exploited and supplied to the market.

Although the investors have voluntarily agreed to receive land transfer to carry out mineral exploitation procedures, have paid exploitation rights fees for all mineral reserves allowed to be exploited, invested in exploitation and declared and paid taxes and fees according to regulations, contributing to meeting the investment and construction needs and socio-economic development of the locality, the violations need to be considered to clarify responsibilities to have appropriate handling measures according to regulations.

From the content of the inspection results and conclusions, the Government Inspector General requested the Chairmen of the People's Committees of Ho Chi Minh City, Dong Nai City and Dong Thap province to urgently direct and implement the contents on administrative handling and economic handling.

In the process of inspection, review, and handling of administrative and economic matters mentioned above, if violations with signs of crime are detected, the Chairmen of the People's Committees of Ho Chi Minh City, Dong Nai City and Dong Thap province will transfer information to the investigating police agency for consideration and settlement according to their authority and legal regulations" - The Government Inspectorate's Conclusion clearly stated.
