Politburo Member, Standing Deputy Prime Minister Pham Gia Tuc - Chairman of the Amnesty Advisory Council has just signed Guidance No. 33/HD-HDTVĐX on the implementation of Decision No. 457/QD-CTN of the President on amnesty in 2026.
According to the guidance, the subjects for special amnesty include: People who have been sentenced to imprisonment for a definite term or life imprisonment and have been reduced to imprisonment for a definite term and are serving imprisonment sentences in prisons or temporary detention centers (convicts); people who are being temporarily suspended from serving imprisonment sentences.
For prisoners who have been temporarily suspended from serving prison sentences or have been subjected to compulsory judicial measures for treatment and have returned to prisons or temporary detention centers, to continue serving their sentences, in addition to the quarters that have been classified for each level of sentence during the period of serving prison sentences being classified as good or good, they must also be certified by the People's Committee of the commune where they reside, the military unit assigned to manage during the period of temporary suspension or the medical facility receiving treatment during the period of compulsory judicial measures for treatment as having strictly complied with the provisions of law and the provisions of the medical facility.
The time of serving a prison sentence is the time of being temporarily detained, temporarily imprisoned, serving a prison sentence in a prison or temporary detention center, regardless of the time of being released on bail, being postponed, temporarily suspended and the time of being reduced the term of imprisonment.
Regarding the regulations on the implementation of additional penalties such as fines, payment of court fees, enforcement of property return obligations, compensation for damages, and other civil obligations:
Prisoners or people who are being temporarily suspended from serving imprisonment sentences who have not completed additional penalties such as fines or payment of court fees but have been decided by the Court to be exempted from fines or payment of court fees are also eligible for the conditions specified in point c, clause 1, Article 3 of the Decision on special amnesty in 2026.
Prisoners or people who are being temporarily suspended from serving prison sentences who have completed the obligation to return property, compensate for damages, and other civil obligations specified in point d, clause 1, Article 3 of the 2026 amnesty decision are one of the cases specified in clause 2, Article 4 of Decree No. 52.
Regarding the implementation time, from April 22, 2026 to May 2, 2026, inter-sectoral appraisal teams will directly go to units and localities to inspect and appraise dossiers and lists of requests for special amnesty.
From April 26, 2026 to May 10, 2026, the Standing Committee of the Amnesty Advisory Council will summarize dossiers and lists and transfer them to members of the Amnesty Advisory Council for research and appraisal.
From May 10, 2026 to May 20, 2026, the Standing Committee of the Amnesty Advisory Council, the Supreme People's Court, will summarize the opinions of the members of the Amnesty Advisory Council and prepare dossiers and lists of people eligible for amnesty, and lists of people not eligible for amnesty to submit to the Advisory Council for consideration and approval.
From May 24, 2026 to May 26, 2026, the Amnesty Advisory Council will meet to review the list of exemptions.
From May 27, 2026 to May 28, 2026, the Standing Committee of the Amnesty Advisory Council will summarize and complete the list of amnesty and submit it to the President for decision.
Hold a press conference to announce the President's amnesty decision on May 30, 2026.
Organize the release of people granted amnesty according to the President's decision on June 1, 2026.
