The Ministry of Home Affairs has completed and sent its opinion on the draft Submission and draft Law on Cadres and Civil Servants (amended) to the Ministry of Justice for appraisal. The bill is expected to be submitted to the National Assembly at the upcoming 9th session.
The report on the Law on Cadres and Civil servants (amended) clearly states one of the new points of the Draft Law is to amend the regulations related to the recruitment, use and management of cadres and civil servants according to the job position to streamline the payroll, restructure and improve the quality of cadres and civil servants in the process of arranging and streamlining the organization of the political system.
Accordingly, the Draft Law amending the concept of job position (is the position, title and job of a cadres and civil servants associated with the functions, tasks and structure of agencies, organizations and units), in which, abandoning the content "associated with structure and civil servant rank", and "to identify payroll" to overcome the duplication of management according to employment positions and manage by public servants; Do not serve as a basis for the units to increase the payroll.
According to the Ministry of Home Affairs, innovating the management of cadres and civil servants according to job positions will play a very important role in building a team of cadres and civil servants who are qualified, effective, efficient, and effective, innovating the thinking of managing cadres and civil servants according to job positions, instead of ranks and levels.
Clause 2, Article 19 of the draft Law states the job position of civil servants including: Job position as leader and manager; Job position as professional or technical; Job position as support or service.
For support and service positions, civil servant management agencies can sign labor contracts to implement them.
Clause 1, Article 20 also stated the basis for determining the job position of civil servants, including: functions, tasks and organizational structure of agencies, organizations and units using civil servants; The level of complexity, properties, characteristics and scale of operation; scope and object of service; professional management processes according to the provisions of specialized laws; The level of office modernization, equipment, working facilities, application of information technology, digital conversion;
In addition to the provisions in Points a, b, c, Clause 1 of this Article, local agencies and organizations depend on geographical location; nature, scale, population structure; economic and urbanization development speed; socio-economic development strategy; local security and order situation to specify more appropriately.
According to the Ministry of Home Affairs, because the mechanism for managing cadres and civil servants from ranks and positions is not linked to the structure and ranks of civil servants related to people, there needs to be a suitable roadmap to change the thinking, awareness to behavior in the arrangement and assignment of cadres and civil servants, as well as the issuance of new salary tables according to job positions.
Therefore, it is recommended that the Government develop a roadmap and issue regulations on gradual management conversion according to job positions within 5 years from the effective date of this Law. Within 5 years, the recruitment, management, use and payment of salaries for cadres and civil servants will continue to be implemented in accordance with the current regulations of the Government (Clause 2, Article 53).
