This is the content stated in Official Dispatch No. 84/TTg-TCCV of the Prime Minister requesting ministries, branches, and localities to continue to improve and enhance the effectiveness and efficiency of the 2-level local government model.
The Prime Minister requested the Ministry of Home Affairs to urgently review and propose amendments and supplements to regulations related to labor and employment to ensure compliance with the provisions of the Law on Organization of Local Government, helping localities have a basis for authorizing commune-level People's Committees to perform good management work, in accordance with the 2-level local government model.
Urgently advise and submit to competent authorities to amend Decree No. 126/2024/ND-CP dated October 8, 2024 of the Government stipulating the organization, operation and management of associations and amend Decision No. 30/2011/QD-TTg dated June 1, 2011 of the Prime Minister on the remuneration regime for retirees holding full-time leadership positions at associations after the Politburo's policy.
According to Decision No. 30/2011/QD-TTg when implementing the 3-level local government model, the monthly remuneration level for retirees holding full-time leadership positions at the head of associations is regulated as follows:
For associations with operating scope nationwide or inter-provincial: Not exceeding 6.50 times the general minimum wage;
For associations with operating scope in provinces and centrally-run cities:
Hanoi and Ho Chi Minh City: Not exceeding 5.40 times compared to the general minimum wage;
Provinces and cities directly under the Central Government remaining: Not exceeding 5.00 times compared to the general minimum wage.
For associations with operating scope in districts, districts, towns, and cities under the province:
Districts belonging to Hanoi and Ho Chi Minh City, cities belonging to provinces: Not exceeding 3.60 times the general minimum wage;
Districts, districts, and towns remaining: Not exceeding 3.20 times compared to the general minimum wage.
For associations with operating scope in communes, wards, and towns: Not exceeding 1.50 times the general minimum wage.
Based on the maximum remuneration level for retirees holding full-time leadership positions at the head of associations, associations specify the monthly remuneration level for retirees holding the remaining full-time leadership positions to ensure internal correlation, publicity, democracy, transparency and appropriateness.
Regarding the source of funding for implementation, for associations with specific characteristics: The funding for implementing the remuneration regime is allocated annually by the state budget according to the provisions of the law on the state budget.
For the remaining associations, the funding for implementing the remuneration regime is guaranteed by the association.
Article 39 of Decree No. 126/2024/ND-CP has stipulated the central budget to support associations assigned tasks by the Party and State at the central level, including:
Pay salaries, allowances and other regimes and policies as prescribed for people of working age who are assigned or transferred to work at the association according to the decision of the competent authority and the person recruited in the association's payroll quota;
remuneration regime for those who have retired and hold the positions of Chairman and full-time Vice Chairman of the association;
The expenditure for regular activities is calculated according to the allocation norms for state management expenditures, the Party, and mass organizations such as state administrative agencies at the central level according to the assigned staffing number;
Facilities and means of operation shall comply with the provisions of land law, law on public assets, law on state budget and related laws.
