According to the expected program, at the First Session, the 16th National Assembly will consider and pass the Law on Civil Status Registration (amended).
This Law stipulates civil status; rights, obligations, principles, powers, methods of implementing civil status registration; Civil status database and state management of civil status.
Article 9 of the draft law stipulates many principles for civil status registration, exploitation, and sharing of civil status data.
That is to respect and ensure the personal rights of individuals; all civil status events of individuals must be fully, promptly, truthfully, objectively and accurately registered.
Each civil status event is only allowed to be registered once, without duplication at the competent civil status registration agencies of Vietnam, except for re-registration of marriage.
The civil status registration agency is responsible for checking information in the Civil Status Database and related databases before carrying out civil status registration.
Ensure publicity and transparency of civil status registration procedures; civil status registration agencies are responsible for proactively exploiting electronic data, searching for information in relevant databases, in accordance with the response level of the database, not requiring submission, presentation or upload of documents that are components of the dossier, except in cases where information cannot be exploited or the exploited information is incomplete or inaccurate.
The collection, processing, sharing, and exploitation of civil status data must ensure safety, confidentiality, for the right purpose, and in accordance with regulations on personal data protection.
Regarding the authority to register civil status, the draft law stipulates that the commune-level People's Committee does not depend on the place of residence of the individual registering civil status matters specified in Article 4 of this Law.
The Chairman of the Commune-level People's Committee has the authority to sign civil status papers. Based on the actual situation in the locality, the Chairman of the Commune-level People's Committee authorizes the signing of civil status papers according to regulations, except for Birth Certificates, Marriage Certificates, Death Certificates and civil status papers in cases of civil status registration with foreign elements.
