On November 3, according to information from the Ha Nam Provincial Inspectorate, this agency has just sent a document to the Chairmen of the People's Committees of districts and Directors of provincial departments to prepare a preliminary report on inspection work in the fourth quarter and the whole year of 2024. Including the content of implementing inspection conclusions.
Department IV is required to synthesize the work of supervision, inspection, and post-inspection handling and coordinate with Department I to synthesize data containing inspection results, urge the implementation of inspection conclusions, decisions on inspection handling, report results for general synthesis, and submit to the Provincial People's Committee to report to the Government Inspectorate.
Previously, the Ha Nam Provincial Inspectorate also issued an official dispatch urging the implementation of inspection conclusions for the Department of Transport, Thanh Liem District People's Committee, Duy Tien Town People's Committee, Kim Bang District People's Committee, Department of Agriculture and Rural Development and a number of enterprises such as HDT Construction, Service and Trading Company Limited, Thanh An 77 Joint Stock Company.
The Inspectorate of Ha Nam province also urged departments, branches, sectors, and district-level People's Committees in the province to report on the results of implementing Inspection Conclusion No. 2211 of the Government Inspectorate on compliance with legal regulations in land management and use, and management of basic construction investment in Ha Nam province (period 2012-2018).
This inspection conclusion has many notable contents, in which the Government Inspectorate decided to transfer the case file related to the Muong Thanh Hotel, Trade Center and Apartment Complex Project for sale and lease (Complex Project) to the Ministry of Public Security for consideration and handling according to the provisions of law.
According to the inspection conclusion, the above Complex Project is invested on an area of 1.25 hectares. The land for implementing the project is clean land, and has been cleared.
However, the Standing Committee of Ha Nam Provincial Party Committee issued Conclusion No. 11-KL/TU dated December 10, 2015, agreeing in principle to appoint Dien Bien Province Construction Private Enterprise No. 1 as the investor to implement the project.
Ha Nam Provincial People's Committee then issued Decision No. 1537/QD-UBND dated October 6, 2016 deciding on the investment policy and selecting the project investor without going through the form of land use rights auction.
The inspection conclusion also clearly stated that the investor started construction of the project without being allocated or leased land, violating the Land Law, Construction Law and Decree 59/2015 of the Government.
"Constructing the project without a construction permit, transferring 118/130 apartments when they did not meet the transfer conditions - without a certificate of land use rights, violating the Law on Real Estate Business", the Government Inspectorate pointed out the investor's violations.
In early 2023, considering the inspection conclusion, Deputy Prime Minister Le Minh Khai requested the Government Inspectorate to transfer the case related to the Muong Thanh Hotel, Trade Center and Apartment Complex Project for sale and lease in Phu Ly City to the Ministry of Public Security according to regulations.
At the same time, transfer the inspection conclusion to the Central Inspection Committee for consideration and handling according to its authority with organizations and individuals related to the violations and shortcomings stated in the Inspection Conclusion.
