The guidelines clearly state the organization of amnesty for people according to the President's Decision on September 1, 2025.

Member of the Politburo, Permanent Deputy Prime Minister Nguyen Hoa Binh - Chairman of the Amnesty Advisory Council has just signed Instruction 94/HD-HDTVDX on the implementation of Decision No. 1244/2025/QD-CTN dated July 3, 2025 of the President on amnesty in 2025 (phase 2).

According to the instructions, the subjects of amnesty include:

1. The person sentenced to a term of imprisonment or life imprisonment has been reduced to a term of imprisonment and is serving a prison sentence at a prison or temporary detention camp (prison).

2. A person whose prison sentence is temporarily suspended.

According to the provisions of Point c, Point e, Clause 1, Article 18 of Decree No. 118/2024/ND-CP dated September 30, 2024 of the Government detailing the implementation of a number of articles of the Law on Enforcement of Criminal Judgments, the prison sentence in the second quarter will be classified as serving on the last day of May.

Therefore, up to the time when the Prisons and detention centers meet to consider and request amnesty, prisoners must have quarters that have enough time to be classified as good or good for each sentence and the next period is from June 1 to the date the Council meets to consider and request amnesty of the prison or detention center is commented and evaluated as the results of serving the prison sentence are quite good or good.

The period of serving a prison sentence is the period of being detained, temporarily detained, or serving a prison sentence in a prison or holding facility, not including the period of being released on bail, being deferred, temporarily suspended, and the period of being reduced from the prison sentence.

The period of application of compulsory treatment measures during the investigation, prosecution, trial and execution of judgments will also be counted as the period of serving a prison sentence.

The reduced prison sentence serving period is counted as a deduction from the remaining prison sentence serving period.

For example: Nguyen Van A was sentenced to 12 years in prison, arrested on August 31, 2016, as of August 31, 2025, Nguyen Van A has actually served 9 years, his prison sentence has been reduced 03 times, to a total of 2 years, the remaining prison sentence is 1 year.

Regarding the implementation period, from July 20 to August 2, the interdisciplinary appraisal teams will directly visit units and localities to check and appraise records and lists of proposals for amnesty consideration.

From July 24 to August 8, the Standing Committee of the Amnesty Advisory Council will synthesize the dossier and list and forward it to the members of the Research and Appraisal of the Amnesty Advisory Council.

From August 8 to August 18, the Standing Committee of the Amnesty Advisory Council, the Supreme People's Court will synthesize the opinions of the members of the Amnesty Advisory Council and prepare documents, a list of people eligible to request an amnesty, and a list of people who are not eligible to request an amnesty to submit to the Advisory Council for approval.

From August 24 to August 26, the Amnesty Advisory Council met to review and approve the list of amnesty.

From August 27 to August 28, the Standing Committee of the Amnesty Advisory Council will synthesize and complete the list of amnesty and submit it to the President for decision.
