The Party Committee of the Supreme People's Court has just issued Resolution No. 753 on reviewing and rearranging the organization of the People's Court apparatus after summarizing Resolution 18-NQ/TW. This Resolution proposes a plan to continue streamlining the apparatus in the People's Court system, from the Supreme to the district level.
For the Supreme People's Court, there are 3 units that must reduce departments and units. In which, Cong Ly Newspaper from 10 units down to 5 units, including: Reporter Department, Editorial Secretary Department; Administrative Department; Finance - Accounting Department; Communications and Digital Content Development Department; Dissolving 8 representative offices; leaving 2 representative offices in Ho Chi Minh City and Da Nang according to the provisions of the Press Law.
Reduce the functions, tasks and organizational structure of the People's Court Magazine, ensuring that it operates in accordance with its principles and purposes. Accordingly, the magazine has reduced its five tasks to one task, which is "a forum for legal science, exchanging practical and theoretical experiences on resolving and adjudicating cases, matters, organization and activities of the People's Court" and added the task of "researching judicial science".
Regarding the organizational structure, the People's Court Magazine has been reduced from 4 units to 3 units, including the Editorial Board, the Board of Trustees and the Trial Science Research Department. The magazine needs to prioritize the use of collaborators who are officials who have worked and are working in the court system.
The new resolution also requires the reduction of the Judicial Academy's apparatus from 13 units to 8 units; the International Cooperation Department's apparatus from 3 units to 2 including: International Relations Department, International Law Department. The Inspection Department is also subject to reduction from 4 units to 3.
The Southern Affairs Department and the Emulation and Reward Department will be merged into the Supreme People's Court Office and reorganized.
Regarding the High-level People's Courts, Resolution 753 states that the Economic Court and the Labor Court under the High-level People's Courts in Hanoi and Ho Chi Minh City will be dissolved. After the reorganization, these two high-level courts will only have four specialized courts, including: Criminal, Civil, Administrative, Family and Juvenile.
The High People's Court in Da Nang will also dissolve the Economic Court, Labor Court, and Administrative Court. After the reorganization, this unit will have 3 specialized courts, including: Criminal, Civil, Family and Juvenile.
The new resolution also requires the dissolution of the Director and Inspection Department. Establishment of 2 Departments of Final Appeal and Retrial at the People's Court in Hanoi and the High People's Court in Ho Chi Minh City. Establishment of 1 Department of Final Appeal and Retrial at the High People's Court in Da Nang.
The offices of the High People's Courts will be reduced from 4 departments to 3, including the Judicial Administration Department (based on the merger of the Records Department and the Judicial Administration Department); the Organization and Personnel Department; and the Accounting and Administration Department.
For provincial-level People's Courts, Resolution 753 requires the dissolution of the Labor Court under the Hanoi People's Court and the Ho Chi Minh City People's Court. After the reorganization, these two units will have 5 specialized courts, including: Criminal Court, Civil Court, Family and Juvenile Court, Economic Court, and Administrative Court.
Dissolve the Labor Court and the Economic Court under the People's Courts of Binh Duong and Dong Nai provinces. After the reorganization, the courts of these two provinces will have 4 specialized courts, including: Criminal Court, Civil Court, Family and Juvenile Court, and Administrative Court.
For district-level People's Courts, the resolution requires the dissolution of specialized courts. In particular, Thu Duc City People's Court and Bien Hoa City People's Court are allowed to organize specialized courts, including: Criminal Court, Civil Court, Family and Juvenile Court.
