The Government has issued Decree No. 69/2026/ND-CP amending and supplementing a number of articles of Decree No. 106/2025/ND-CP dated May 15, 2025 stipulating penalties for administrative violations in the field of fire prevention, fighting and rescue (PCCC and CNCH).
According to new regulations, the act of equipping fire fighting, rescue, and mechanical rescue vehicles that do not meet regulations will be fined from 30,000 VND to 40,000 VND.
At the same time, Decree No. 69/2026/ND-CP also stipulates a fine of between 3,000,000,000 VND and 5,000,000,000 VND for one of the following acts: Failure to maintain sufficient quantity or not ensuring technical requirements according to regulations of common fire fighting vehicles, rudimentary demolition tools that have been equipped and installed; failure to maintain fire-fighting water reserves as prescribed.
A fine of between VND 20,000,000 and VND 25,000,000 shall be imposed for the act of not maintaining fire prevention and fighting distance between houses and works.
A fine of between 300,000 VND and 40,000 VND shall be imposed for the act of not equipping or installing fire-resistant materials or fire-resistant doors or firewalls or fire screens or fire-resistant curtains or fire-resistant materials.
According to the new regulations, the authority to sanction administrative violations of the People's Police is regulated as follows:
- People's Police soldiers on duty have the right to: Warning; fine up to 5,000 VND and confiscate administrative violation exhibits worth not exceeding 2 times the prescribed fine.
- Heads of mobile police units at the company level have the right to: Issue a warning; fine up to 10,000,000 VND and confiscate administrative violation exhibits worth not exceeding 2 times the fine level specified above; apply remedial measures specified in point a, clause 1, Article 28 of the Law on Handling of Administrative Violations.
- Heads of Police stations, Heads of Mobile Police units at battalion level, Flotilla Commanders, Station Heads, Team Leaders have the power to: Issue warnings; fine up to 15,000,000,000 VND; suspend operations for a limited time; confiscate administrative violation exhibits with a value not exceeding 2 times the fine level specified above; apply remedial measures.
- The Head of the commune-level Police has the power to: Issue a warning; fine up to 25,000 VND; suspend operations for a limited time; confiscate exhibits of administrative violations; apply remedial measures.
- Provincial-level Police Directors have the power to: Issue a warning; fine up to 500,000 VND; revoke the right to use a license that is a design appraisal document on fire prevention and fighting, a document approving the results of fire prevention and fighting acceptance; suspend operations for a limited time; confiscate exhibits of administrative violations; apply remedial measures.
- Director of the Department of Administrative Management of Social Order, Director of the Department of Traffic Police, Director of the Department of Fire Prevention and Fighting and Rescue Police have the power to: Issue a warning; fine up to 50,000 VND; revoke the right to use a license that is a design appraisal document on fire prevention and fighting, a document approving the results of fire prevention and fighting acceptance; confiscate exhibits of administrative violations; suspend operations for a limited time; apply remedial measures.
Decree No. 69/2026/ND-CP takes effect from April 20, 2026.
