University of Transport and Communications leases more than 1,700m2 of land in violation of regulations

The Government Inspectorate clearly pointed out that the University of Transport and Communications leased more than 1,700m2 of land in violation of regulations.

On August 19, the Government Inspectorate publicly announced the Conclusion of the inspection of redundant houses and land after arrangement at the Ministry of Education and Training (MOET).

In which, the Government Inspectorate said that the housing and land facilities managed by the Ministry of Education and Training that must be arranged according to Decree No. 03/2025/ND-CP are 62 facilities.

Implementation results from March 1, 2025 to April 30, 2026, the Ministry of Education and Training has approved and completed the arrangement plan: 21/62 institutions (accounting for 33.8%), and 39/62 institutions have not completed arrangement (accounting for 62.9%), 2/62 institutions have been approved by the Ministry of Finance before March 1, 2025.

The Government Inspectorate inspected dossiers of 29 establishments and units, and in the process of implementation, there were still shortcomings, limitations, and violations.

Notably, through field inspection, the procedures for preparing, approving, and organizing auctions for 4 leasing facilities: Ho Chi Minh City Open University; Hanoi University, University of Transport and Hanoi University of Science and Technology. The schools have prepared lease projects, however, the procedures for preparing and approving still have errors, some house and land items are included in the Project but have not been specifically approved by competent authorities:

The project on using public assets approved in Decision No. 1304/QD-ĐHHN dated April 14, 2026 of Hanoi University, lacks the content "Proposals, recommendations for implementing the Project" according to Form 03/TSC-ĐA, and is not implemented in accordance with the provisions of Clause 2, Article 52 of Decree No. 186/2025/ND-CP.

The University of Transport and Communications leasing factory items (land area: 1. 724.2m2, factory area: 500m2) to Registration Center 29-03V at address No. 3 Cau Giay Street, Lang Ward, Hanoi City from 2019 to July 2025 has the following violations:

University of Transport and Communications leasing public assets (from 2019 to July 2025) has not been approved for the Project by competent authorities, intentionally violating point a, clause 2, Article 55 of the Law on Management and Use of Public Assets in 2017.

The Ministry of Education and Training lacks inspection and supervision of the University of Transport, violating the provisions of point c, clause 1, Article 16 of the Law on Management and Use of Public Assets in 2017.

The Government Inspector General requests the Ministry of Education and Training to rectify management work.

Inspect and review housing and land facilities under the management authority of the Ministry to have a plan to rearrange, thoroughly handle existing problems, limitations, and obstacles, complete the rearrangement and handling of housing and land, put housing and land facilities into operation and use, and avoid waste.

Inspect the compliance with standards and norms for using public assets under the management authority and responsibility of the Ministry; review, rectify, and promptly handle units directly under the Ministry that use houses and land for lease, ensuring compliance with legal regulations.

Direct units under and directly under the Ministry to carry out the registration of land and assets attached to land in accordance with the provisions of the Land Law; work with competent authorities to implement procedures and definitively resolve cases of lack of legal documents, encroachment, and disputes according to regulations.
