This content is stipulated by the Government in Decree No. 335/2026/ND-CP on social assistance policies. The Decree takes effect from October 5, 2026.
Article 9 of Decree No. 335/2026/ND-CP stipulates the termination or suspension of social allowance and financial support for monthly care and nurturing.
1. Temporarily suspend enjoyment of social allowances, financial support for monthly care and nurturing in cases specified as follows:
a) Subjects who do not receive regimes and policies continuously for 3 months or more;
b) Subjects who do not comply with the requests of competent state agencies on re-determining the level of disability, re-determining the conditions for enjoying social allowances, supporting monthly care and nurturing expenses or other information serving the management of subjects.
2. Stop receiving monthly social allowances when falling into one of the cases specified as follows:
a) Subjects who die or are missing according to the provisions of law;
b) Subjects who are no longer eligible to enjoy according to the provisions of Article 5 (regulating subjects of regular social assistance in the community) of this Decree;
c) Subjects serving prison sentences in prison or having a decision from a competent state agency on termination of enjoyment;
d) Subjects refusing to receive regimes and policies;
e) After 3 months from the date of the decision to temporarily suspend policy payments as prescribed in point b, clause 1 of this Article, the subject still does not carry out procedures to re-determine the level of disability, re-determine the conditions for enjoyment or provide other information to serve the management of the subject at the request of a competent state agency.
3. Stop enjoying financial support for monthly care and nurturing when falling into one of the following cases:
a) Subjects receiving care, nurturing or recipients of care, nurturing die or are missing according to the provisions of law;
b) Subjects who are entitled to care and nurturing are no longer eligible as prescribed in Clause 1, Point b, Clause 5 and Clause 6, Article 5 of this Decree;
c) The person receiving care and nurturing does not meet the conditions specified in Article 19 (CONDItions and responsibilities for people receiving care and nurturing children), Article 20 (CONDItions and responsibilities for households and individuals receiving care and nurturing of people with disabilities and the elderly) of this Decree;
d) The person receiving care and nurturing is administratively sanctioned in the field of social protection, social assistance and children or convicted by a legally effective judgment.
4. In case a decision has been made to temporarily suspend enjoying regimes and policies according to the provisions of Clause 1 of this Article, and after reviewing the dossiers and data of the subjects, the conditions for enjoying regimes and policies do not change, the subjects continue to enjoy regimes and policies from the time of temporary suspension of enjoying regimes and policies.
In case the subject is no longer eligible to enjoy, the Chairman of the commune-level People's Committee decides to terminate the enjoyment of regimes and policies from the time of temporary suspension of enjoyment.
In case the subject changes the conditions for enjoying regimes and policies, adjust the regime and policies from the time of changing the conditions for enjoying regimes and policies.
