Village heads and heads of residential groups have the right to convene and chair community meetings

The authority to convene and chair a community meeting of village heads and heads of residential groups is stipulated in Decree 59/2023.

Currently, the Ministry of Home Affairs is drafting a decree on the organization and operation of villages and residential groups and a number of regimes and policies for part-time workers to submit to the Government for consideration and decision.

Contents related to the process of electing village heads and heads of residential groups, according to the Ministry of Home Affairs, are stipulated in the Law on Grassroots Democracy and Decree 59/2023 of the Government detailing a number of articles of the Law on Grassroots Democracy.

The Ministry of Home Affairs emphasized that these regulations are in effect and are still suitable when implementing the 2-level local government model.

Article 3 of Decree 59/2023 clearly stipulates the organization of community meetings for people to discuss and decide.

Accordingly, the authority to convene, chair and organize meetings of the community is regulated as follows:

Village heads and heads of residential groups convene and chair meetings of the community for the people to discuss and decide on the contents specified in Clauses 1, 2, 3, 5 and 6, Article 15 of the Law on Grassroots Democracy.

The election team (established by the Chairman of the People's Committee at the commune level) convene and chair a meeting of the community to elect village heads and residential group leaders.

The Head of the Front Working Committee in the village or residential group will convene and chair a meeting of the residential community to dismiss the head of the village or residential group.

In case the village chief or the head of the residential group is also the Head of the Front Working Committee, the Chairman of the Commune People's Committee shall convene and chair the meeting after reaching an agreement with the Chairman of the Vietnam Fatherland Front Committee at the commune level.

In case of defective village heads or residential group leaders, the Chairman of the People's Committee at the commune level shall appoint representatives of the Front Working Committee in the village, residential group or summoners who are citizens with a prestige residence in the village or residential group to convene and organize a meeting of the residential community for the people to discuss and decide on the contents except for the cases specified in Point b, Point c, Clause 1 of this Article.

The head of the village or residential group or the head of the residential group shall authorize a member of the Front Working Committee in the village or residential group or a citizen with a prestige residing in the residential group to preside over and chair a meeting of the residential group and report the results to the head of the village or residential group to synthesize and summarize the general results of the entire village or residential group.
